1 AMENDMENT TO HOUSE BILL 3485
2 AMENDMENT NO. . Amend House Bill 3485 as follows:
3 by replacing the title with the following:
4 "AN ACT to amend the Abandoned Housing Rehabilitation
5 Act."; and
6 on page 1, line 6, by replacing "Section 3" with "Sections 2
7 and 3"; and
8 on page 1, below line 6, by inserting the following:
9 "(310 ILCS 50/2) (from Ch. 67 1/2, par. 852)
10 Sec. 2. Definitions. As used in this Act:
11 (a) "Property" means any residential real estate for
12 which taxes are delinquent for the preceding 2 years and
13 which has been continuously unoccupied by persons legally in
14 possession for the preceding 1 year.
15 (b) "Nuisance" means any property which because of its
16 physical condition or use is a public nuisance, or any
17 property which constitutes a blight on the surrounding area,
18 or any property which is not fit for human habitation under
19 the applicable fire, building and housing codes. "Nuisance"
20 also means any property on which any illegal activity
21 involving controlled substances (as defined in the Illinois
22 Controlled Substances Act) or cannabis (as defined in the

1 Cannabis Control Act) takes place or any property on which
2 any streetgang-related activity (as defined in the Illinois
3 Streetgang Terrorism Omnibus Prevention Act) takes place.
4 (c) "Organization" means any Illinois corporation,
5 agency, partnership, association, firm or other entity
6 consisting of 2 or more persons organized and conducted on a
7 not-for-profit basis with no personal profit inuring to
8 anyone as a result of its operation which has among its
9 purposes the improvement of housing.
10 (d) "Parties in interest" means any owner or owners of
11 record, judgment creditor, tax purchaser or other party
12 having any legal or equitable title or interest in the
13 property.
14 (e) "Last known address" includes the address where the
15 property is located, or the address as listed in the tax
16 records or as listed pursuant to any owner's registration
17 ordinance duly adopted by a home rule unit of government.
18 (f) "Low or moderate income housing" means housing for
19 persons and families with low or moderate incomes, provided
20 that the income limits for such persons and families shall be
21 the same as those established by rule by the Illinois Housing
22 Development Authority in accordance with subsection (g) of
23 Section 2 of the Illinois Housing Development Act, as
24 amended.
25 (g) "Rehabilitation" means the process of improving the
26 property, including but not limited to bringing property into
27 compliance with applicable fire, housing and building codes.
