1 AMENDMENT TO HOUSE BILL 3756
2 AMENDMENT NO. . Amend House Bill 3756 by replacing
3 the title with the following:
4 "AN ACT in relation to public employee benefits."; and
5 by replacing everything after the enacting clause with the
6 following:
7 "Section 5. The Illinois Pension Code is amended by
8 changing Section 17-142.1 as follows:
9 (40 ILCS 5/17-142.1) (from Ch. 108 1/2, par. 17-142.1)
10 Sec. 17-142.1. To defray health insurance costs. To
11 provide for the partial reimbursement of health insurance
12 costs.
13 (1) On the first day of September of each year,
14 beginning in 1988, the Board may, by separate warrant, pay to
15 each recipient of a service retirement, disability retirement
16 or survivor's pension an amount to be determined by the
17 Board, which shall represent partial reimbursement for the
18 cost of the recipient's health insurance coverage.
19 (2) In lieu of the annual payment authorized in
20 subdivision (1), for pensioners enrolled in the Fund's
21 regular health care deduction plans, the Fund may pay the

1 health insurance premium reimbursement on a monthly rather
2 than annual basis, at the percentage rate established from
3 time to time by the Board. If the Board so directs, these
4 monthly payments may be made in the form of a direct payment
5 of premium and a reduction in the amount deducted from the
6 annuity, rather than in the form of reimbursement by separate
7 warrant.
8 (3) Total payments under this Section in any year may
9 not exceed $40,000,000 $25,000,000 plus any amount that was
10 authorized to be paid under this Section in the preceding
11 year but was not actually paid by the Board.

13 Section 90. The State Mandates Act is amended by adding
14 Section 8.24 as follows:
15 (30 ILCS 805/8.24 new)
16 Sec. 8.24. Exempt mandate. Notwithstanding Sections 6
17 and 8 of this Act, no reimbursement by the State is required
18 for the implementation of any mandate created by this
19 amendatory Act of the 91st General Assembly.
20 Section 99. Effective date. This Act takes effect upon
21 becoming law.".
