1 AMENDMENT TO HOUSE BILL 3899
2 AMENDMENT NO. . Amend House Bill 3899 by replacing
3 the title with the following:
4 "AN ACT to amend the Criminal Code of 1961 by adding
5 Section 12-7.5."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Criminal Code of 1961 is amended by
9 adding Section 12-7.5 as follows:
10 (720 ILCS 5/12-7.5 new)
11 Sec. 12-7.5. Cyberstalking.
12 (a) A person commits cyberstalking when he or she,
13 knowingly and without lawful justification, on at least 2
14 separate occasions, harasses another person through the use
15 of electronic communication and:
16 (1) at any time transmits a threat of immediate or
17 future bodily harm, sexual assault, confinement, or
18 restraint and the threat is directed towards that person
19 or a family member of that person, or
20 (2) places that person or a family member of that
21 person in reasonable apprehension of immediate or future

1 bodily harm, sexual assault, confinement, or restraint.
2 (b) As used in this Section:
3 "Harass" means a knowing and willful course of conduct
4 directed at a specific person that alarms, annoys, torments,
5 or terrorizes that person.
6 "Electronic communication" means any transfer of signs,
7 signals, writings, sounds, data, or intelligence of any
8 nature transmitted in whole or in part by a wire, radio,
9 electronmagnetic, photoelectric, or photo-optical system.
10 "Electronic communication" includes transmissions by a
11 computer through the Internet to another computer.
12 (c) Sentence. Cyberstalking is a Class 4 felony. A
13 second or subsequent conviction for cyberstalking is a Class
14 3 felony.
15 Section 99. Effective date. This Act takes effect upon
16 becoming law.".
