1 AMENDMENT TO HOUSE BILL 3917
2 AMENDMENT NO. . Amend House Bill 3917 as follows:
3 by replacing everything after the enacting clause with the
4 following:
5 "Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2KK as follows:
7 (815 ILCS 505/2KK new)
8 Sec. 2KK. Refund for returned merchandise. Whenever a
9 consumer who paid for merchandise returns the merchandise
10 with a receipt to the seller and the seller has a merchandise
11 return policy in place, the seller shall provide a refund as
12 follows:
13 A refund for returned merchandise with a receipt
14 purchased with cash must be in cash.
15 A refund for returned merchandise with a receipt
16 purchased by credit card or debit card must be by credit to
17 those card accounts.
18 A refund for returned merchandise with a receipt
19 purchased by personal check must be by a check from the
20 seller. When the consumer paid by personal check, the
21 consumer is not entitled to a refund until the consumer's

1 check is honored by the financial institution on which it is
2 drawn.
3 A refund for returned merchandise with a receipt
4 purchased by a check that is guaranteed by a bank or other
5 credit issuer must be in cash.
6 Nothing in this Section shall abridge the right of a
7 consumer to receive a refund for returned merchandise with a
8 receipt in a form different from the method of original
9 payment.
10 A seller that violates this Section commits an unlawful
11 practice under this Act.
12 Section 99. Effective date. This Act takes effect upon
13 becoming law.".
