1 AN ACT to amend certain Acts in relation to support.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The State Finance Act is amended by adding
5 Section 5.541 as follows:
6 (30 ILCS 105/5.541 new)
7 Sec. 5.541. The Child Support Insurance Fund.
8 Section 10. The Illinois Marriage and Dissolution of
9 Marriage Act is amended by adding Section 505.05 as follows:

11 Sec. 505.05. Child support insurance.
12 (a) In this Section:
13 "Obligor" and "order for support" have the meanings
14 ascribed to those terms in the Income Withholding for Support
15 Act, except that "order for support" means only an order for
16 the support of a child and does not mean an order for the
17 maintenance of a spouse.
18 "Program" means the child support insurance program
19 established under this Section.
20 (b) The Administrative Office of the Illinois Courts
21 shall establish a child support insurance program. The
22 program shall provide insurance coverage for the payment of
23 child support in the event of an obligor's involuntary
24 unemployment and resulting inability to make child support
25 payments as required by an order for support. To be eligible
26 for such coverage, the obligor must have been employed
27 full-time and working at least 30 hours per week at the time
28 the order for support was entered. The program shall provide
29 coverage for an obligor's payment of child support for a

1 maximum period of 13 weeks or for a maximum amount of
2 $13,000, whichever occurs first.
3 (c) The Administrative Office of the Illinois Courts
4 shall contract with an insurance company authorized to do
5 business in this State to provide the insurance coverage
6 required under the program.
7 (d) Every order for support shall include a requirement
8 that the obligor pay to the clerk of the court a one-time fee
9 to cover the cost of 3 years of child support insurance
10 coverage under the program. After the expiration of that
11 3-year period, the court may order the obligor to pay an
12 additional amount to the clerk for child support insurance
13 coverage under the program on a yearly basis.
14 (e) There is created in the State treasury a special
15 fund to be known as the Child Support Insurance Fund. All
16 moneys collected by the clerk of the court under subsection
17 (d) shall be deposited into the Fund. Moneys in the Fund
18 shall be appropriated to the Administrative Office of the
19 Illinois Courts for the purpose of funding the child support
20 insurance program under this Section.
21 Section 99. Effective date. This Act takes effect upon
22 becoming law.
