1 AN ACT to amend the Illinois Public Aid Code by adding
2 Section 12-13.3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Public Aid Code is amended by
6 adding Section 12-13.3 as follows:
7 (305 ILCS 5/12-13.3 new)
8 Sec. 12-13.3. W-2 statements for obligors; pilot program.
9 (a) In this Section:
10 "Department" means the Illinois Department of Public Aid.
11 "Obligor" and "obligee" have the meanings ascribed to
12 those terms in the Income Withholding for Support Act.
13 (b) The Department shall establish and administer a pilot
14 program as described in this Section. The Department shall
15 establish the pilot program in 5 counties as follows:
16 (1) Cook County.
17 (2) Two counties with a population of at least
18 650,000 but less than 2,000,000.
19 (3) Two counties with a population less than
20 650,000.
21 A county may apply to participate in the pilot program in
22 the manner and form designated by the Department. The
23 Department shall establish criteria for selecting counties to
24 participate in the pilot program.
25 (c) Under the pilot program, every employer that
26 withholds income from an obligor in any of years 2000 through
27 2003 for the payment of amounts owed under an order for the
28 support of a child shall send to the clerk of the circuit
29 court in the county in which the order was entered a copy of
30 the Form W-2 Wage and Tax Statement furnished by the employer
31 to the obligor for each such year. The employer shall send

1 the Form W-2 to the clerk if the obligor's income is withheld
2 pursuant to the Income Withholding for Support Act. The
3 employer shall send the Form W-2 to the clerk not later than
4 January 31 of the year after the year covered by the Form
5 W-2.
6 (d) Whenever a clerk of the circuit court receives a Form
7 W-2 from an employer as provided in this Section, the clerk
8 shall immediately send a copy of the Form W-2 to the obligor
9 and a copy to the appropriate obligee.
10 (e) The Department shall adopt rules necessary to
11 implement this Section.
12 (f) The Department shall report its findings and
13 recommendations concerning the operation of the pilot program
14 to the Governor and the General Assembly by March 1, 2004.
15 Section 99. Effective date. This Act takes effect upon
16 becoming law.
