1 HOUSE RESOLUTION
2 WHEREAS, To reduce the emission of pollutants by motor
3 vehicles, residents of nonattainment areas in Kane, Will,
4 McHenry, Madison, St. Clair, Kendall, Monroe, Cook, DuPage,
5 and Lake counties who own certain vehicles subject to
6 emission inspection must submit their vehicles to emission
7 inspections; and
8 WHEREAS, These emission inspections are performed by
9 inspectors who have been certified by the Environmental
10 Protection Agency, at official inspection stations, and with
11 equipment that has been certified by the Environmental
12 Protection Agency; and
13 WHEREAS, There have been numerous complaints from vehicle
14 owners concerned with damage to their vehicles which may have
15 occurred during the emission inspection process; it should be
16 relatively easy for a person who has had his or her vehicle
17 damaged during an emission inspection to learn how to file a
18 complaint or claim; and
19 WHEREAS, The Vehicle Emissions Inspection Law of 1995
20 requires the Environmental Protection Agency to establish
21 procedures for resolving disputes concerning emission
22 inspections; and therefore be it
23 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
24 NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
25 we urge the Environmental Protection Agency to have each
26 official inspection station operator: (i) post complaint and
27 claim procedures in the waiting area at each station; that
28 these complaint procedures shall be open, conspicuous,
29 unobstructed from view, and measure at least 2 feet by 4 feet
30 in size; and (ii) keep a record of all complaints and claims
31 against the station and forward a quarterly and yearly
32 summary of these records to the Representative and Senator

1 who have constituents served by the station; and be it
2 further
3 RESOLVED, That a copy of this resolution be delivered to
4 the Director of the Environmental Protection Agency.
