1 HOUSE RESOLUTION
2 WHEREAS, The General Assembly believes that the ability
3 of a landowner to reasonably use water on or beneath his or
4 her property is a right to be enjoyed; this right should not
5 be taken without due process of law; just compensation should
6 be given to those regions or individuals whose ability to use
7 the water is diminished; and
8 WHEREAS, The General Assembly supports the establishment
9 of water management districts, by referendum of affected
10 property owners, for the purpose of managing the water
11 resource; water management districts should be established
12 within aquifers or recharge lines and be governed by elected
13 or appointed directors representing the various water users
14 in the district; regulations, developed by districts, should
15 be based upon the availability of supply and needs and
16 desires of affected property owners; and
17 WHEREAS, The General Assembly further believes water
18 withdrawal regulations should recognize the responsibility of
19 all users to construct and maintain proper wells; current
20 Illinois guidelines for the construction of wells and the
21 type and setting of pumps accomplish this; it is the duty of
22 all users to conserve water to avoid waste of a critical
23 natural resource; conservation programs should encourage use
24 of water recycling where feasible; and
25 WHEREAS, The General Assembly believes that agricultural
26 uses must receive a high priority in the allocation of water
27 supplies; the General Assembly further believes consideration
28 should be given to businesses and consumers who would feel an
29 economic impact from water restrictions; therefore, be it
30 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE
31 NINETY-FIRST GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, that
32 current State statutes and guidelines should not be changed

1 unless the need for modification is shown from facts and
2 research data collected from scientifically valid groundwater
3 studies; and be it further
4 RESOLVED, That the General Assembly recommends continuing
5 research on groundwater availability, recharge and the
6 efficient use of water resources; this research should be
7 designed to develop a conservation program with emphasis on
8 individual, local, and State participation; and be it further
9 RESOLVED, That the General Assembly urges the Illinois
10 State Water Survey to monitor ground water movement in
11 aquifers to determine where water shortages may potentially
12 arise; and be it further
13 RESOLVED, That a suitable copy of this resolution be
14 forwarded to the Director of the Illinois State Water Survey.
