1 AMENDMENT TO SENATE BILL 238
2 AMENDMENT NO. . Amend Senate Bill 238 by replacing
3 the title with the following:
4 "AN ACT to amend the Illinois Dental Practice Act by
5 changing Section 4 and adding Section 5.5."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 5. The Illinois Dental Practice Act is amended
9 by changing Section 4 and adding Section 5.5 as follows:
10 (225 ILCS 25/4) (from Ch. 111, par. 2304)
11 Sec. 4. Definitions. As used in this Act:
12 (a) "Department" means the Illinois Department of
13 Professional Regulation.
14 (b) "Director" means the Director of Professional
15 Regulation.
16 (c) "Board" means the Board of Dentistry established by
17 Section 6 of this Act.
18 (d) "Dentist" means a person who has received a general
19 license pursuant to paragraph (a) of Section 11 of this Act
20 and who may perform any intraoral and extraoral procedure
21 required in the practice of dentistry and to whom is reserved

1 the responsibilities specified in Section 17.
2 (e) "Dental hygienist" means a person who holds a
3 license under this Act to perform dental services as
4 authorized by Section 18.
5 (f) "Dental assistant" means an appropriately trained
6 person who, under the supervision of a dentist, provides
7 dental services as authorized by Section 17.
8 (g) "Dental laboratory" means a person, firm or
9 corporation which:
10 (i) engages in making, providing, repairing or
11 altering dental prosthetic appliances and other
12 artificial materials and devices which are returned to a
13 dentist for insertion into the human oral cavity or which
14 come in contact with its adjacent structures and tissues;
15 and
16 (ii) utilizes or employs a dental technician to
17 provide such services; and
18 (iii) performs such functions only for a dentist or
19 dentists.
20 (h) "Supervision" means supervision of a dental
21 hygienist or a dental assistant requiring that a dentist
22 authorize the procedure, remain in the dental facility while
23 the procedure is performed, and approve the work performed by
24 the dental hygienist or dental assistant before dismissal of
25 the patient, but does not mean that the dentist must be
26 present at all times in the treatment room.
27 (i) "General supervision" means supervision of a dental
28 hygienist requiring that a dentist authorize the procedures
29 which are being carried out, but not requiring that a dentist
30 be present when the authorized procedures are being
31 performed. The authorized procedures may also be performed
32 at a place other than the dentist's usual place of practice.
33 The issuance of a prescription to a dental laboratory by a
34 dentist does not constitute general supervision.

1 (j) "Public member" means a person who is not a health
2 professional. For purposes of board membership, any person
3 with a significant financial interest in a health service or
4 profession is not a public member.
5 (k) "Dentistry" means the healing art which is concerned
6 with the examination, diagnosis, treatment planning and care
7 of conditions within the human oral cavity and its adjacent
8 tissues and structures, as further specified in Section 17.
9 (l) "Branches of dentistry" means the various
10 specialties of dentistry which, for purposes of this Act,
11 shall be limited to the following: endodontics, oral and
12 maxillofacial surgery, orthodontics and dentofacial
13 orthopedics, pediatric dentistry, periodontics and
14 prosthodontics.
15 (m) "Specialist" means a dentist who has received a
16 specialty license pursuant to Section 11(b).
17 (n) "Dental technician" means a person who owns,
18 operates or is employed by a dental laboratory and engages in
19 making, providing, repairing or altering dental prosthetic
20 appliances and other artificial materials and devices which
21 are returned to a dentist for insertion into the human oral
22 cavity or which come in contact with its adjacent structures
23 and tissues.
24 (o) "Impaired dentist" means a dentist who is unable to
25 practice dentistry with reasonable skill and safety because
26 of a physical or mental disability as evidenced by a written
27 determination or written consent based on clinical evidence,
28 including deterioration through the aging process, loss of
29 motor skills, abuse of drugs or alcohol, or a psychiatric
30 disorder, of sufficient degree to diminish the person's
31 ability to deliver competent patient care.

1 Sec. 5.5. Impaired dentist. The Department shall
2 establish by rule a program of care, counseling, and
3 treatment for the impaired dentist.".
