1 AN ACT to amend the Nursing Home Care Act by adding
2 Section 3-206.03.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Nursing Home Care Act is amended by adding
6 Section 3-206.03 as follows:
7 (210 ILCS 45/3-206.03 new)
8 Sec. 3-206.03. Resident attendants.
9 (a) As used in this Section, "resident attendant" means
10 an individual who assists residents in a facility with the
11 following activities:
12 (1) eating and drinking; and
13 (2) personal hygiene limited to washing a
14 resident's hands and face, brushing and combing a
15 resident's hair, oral hygiene, shaving residents with an
16 electric razor, and applying makeup.
17 The term "resident attendant" does not include an
18 individual who:
19 (1) is a licensed health professional or a
20 registered dietitian;
21 (2) volunteers without monetary compensation;
22 (3) is a nurse assistant; or
23 (4) performs any nursing or nursing-related
24 services for residents of a facility.
25 (b) A facility may employ resident attendants to assist
26 the nurse aides with the activities authorized under
27 subsection (a). The resident attendants shall not count in
28 the minimum staffing requirements under rules implementing
29 this Act.
30 (c) A facility may not use on a full-time or other paid
31 basis any individual as a resident attendant in the facility

1 unless the individual:
2 (1) has completed a training and competency
3 evaluation program encompassing the tasks the individual
4 provides; and
5 (2) is competent to provide feeding, hydration, and
6 personal hygiene services.
7 (d) The training and competency evaluation program may
8 be facility-based. It may include one or more of the
9 following units:
10 (1) A feeding unit that is a maximum of 5 hours in
11 length.
12 (2) A hydration unit that is a maximum of 3 hours
13 in length.
14 (3) A personal hygiene unit that is a maximum of 5
15 hours in length.
16 These programs must be reviewed and approved by the
17 Department every 2 years.
18 (f) A person seeking employment as a resident attendant
19 is subject to the Health Care Worker Background Check Act.
20 Section 99. Effective date. This Act takes effect upon
21 becoming law.
