1 AN ACT to amend the Illinois Pesticide Act by adding
2 Section 8.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Pesticide Act is amended by
6 adding Section 8.1 as follows:
7 (415 ILCS 60/8.1 new)
8 Sec. 8.1. Broadcast application in schools.
9 (a) For the purposes of this Section:
10 (1) "Broadcast application" means the application
11 of a pesticide that has the potential to become airborne
12 or that may leave residues on services, including but not
13 limited to pesticides formulated as liquid sprays,
14 aerosols, powders, dusts, and granules.
15 (2) "School" means a structure used as a school in
16 the State of Illinois.
17 (b) Beginning 120 days after the effective date of this
18 amendatory Act of 1999, any school using broadcast
19 application of any pesticide on school property shall comply
20 with the following notification procedures:
21 (1) Signs shall be posted at least 2 business days
22 before broadcast application of the pesticide and shall
23 remain posted at least 2 business days after application
24 of the pesticide. Signs shall be posted (i) at every
25 entry pointed into an enclosed structure where the
26 pesticide is applied and (ii) in highly visible locations
27 around the perimeter of the area if the pesticide is
28 applied in an open area. Signs shall be at least 6" x
29 6", headed "Notice of Pesticide Application", and bright
30 yellow in color with black writing at least 1" in height.
31 Signs shall identify the name and active ingredient of

1 the pesticide, the date of pesticide use, the date and
2 time for re-entry to the area treated if such information
3 is specified on the pesticide label, and the name and
4 contact number for the school personnel responsible for
5 the application. The Illinois Department of Public
6 Health shall be responsible for developing a standardized
7 design and language for the Notice of Pesticide
8 Application signs within 90 days of the effective date of
9 this amendatory Act of 1999.
10 (2) Each school shall maintain a registry of
11 parents and guardians of students and of school employees
12 who have registered to receive written notification prior
13 to broadcast applications of pesticides. Parents and
14 guardians and school employees shall be notified in
15 writing of the registry within 30 days of the first full
16 day of the school year. The registry notice form shall be
17 developed by the Illinois Department of Public Health.
18 (3) Written notification must be provided to all
19 registered parents and guardians of students and to
20 employees who attend or work at the school at least 2
21 business days before broadcast application of any
22 pesticide on school property. Written notices shall
23 identify the name and active ingredient of the pesticide,
24 the date of pesticide use, the date and time for re-entry
25 to the area treated if such information is specified on
26 the pesticide label, and the name and contact number for
27 the school personnel responsible for developing a
28 standardized design and language for the written notices
29 within 90 days of the effective date of this amendatory
30 Act of 1999.
31 (4) Written notice and posting must be provided at
32 least 2 business days in advance if a school is scheduled
33 to have a broadcast application of pesticides on a
34 weekend or other day when school is not in session.

1 (5) Prior written notice shall not be required if
2 there is an imminent threat to health or property. If
3 such a situation arises, the appropriate school personnel
4 must sign a statement describing the circumstances that
5 gave rise to the health threat, ensure that posting takes
6 place, and ensure that written notice is provided as soon
7 as practicable.
8 Section 99. Effective date. This Act takes effect
9 August 15, 1999.
