AN ACT regarding child support.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Marriage and Dissolution of
Marriage Act is amended by adding Section 505.3 as follows:
(750 ILCS 5/505.3 new)
Sec. 505.3. Child support expenses accounting. If a
non-custodial parent paying child support under a court order
believes the custodial parent, despite having enough money
available from child support, the custodial parent's
earnings, and any other sources, is not spending enough money
to support the minor child, the non-custodial parent may
petition the court to order the custodial parent to account
for spending on the child's behalf for a designated recent
period of time. The court may order an accounting if it
finds an accounting is in the best interest of the minor
child.
If the accounting reveals that the custodial parent is
not providing proper support for the child, and the court
finds it is in the best interest of the minor child, the
court may order that an escrow account be established into
which child support payments paid by the non-custodial
parents shall be deposited.
