1 AMENDMENT TO SENATE BILL 752
2 AMENDMENT NO. . Amend Senate Bill 752 on page 1, by
3 replacing line 1 with the following:
4 "AN ACT concerning business assistance."; and
5 on page 1, line 5, by replacing "Section 46.70" with
6 "Sections 46.70 and 46.71"; and
7 on page 3, below line 8, by inserting the following:
8 "(20 ILCS 605/46.71 new)
9 Sec. 46.71. Model domestic violence and sexual assault
10 employee awareness and assistance policy.
11 (a) The Department shall convene a task force including
12 members of the business community, employees, employee
13 organizations, representatives from the Department of Labor,
14 and directors of domestic violence and sexual assault
15 programs, including representatives of statewide advocacy
16 organizations for the prevention of domestic violence and
17 sexual assault, to develop a model domestic violence and
18 sexual assault employee awareness and assistance policy for
19 businesses.
20 The Department shall give due consideration to the
21 recommendations of the Governor, the President of the Senate,
22 and the Speaker of the House of Representatives for

1 participation by any person on the task force, and shall make
2 reasonable efforts to assure regional balance in membership.
3 (b) The purpose of the model employee awareness and
4 assistance policy shall be to provide businesses with the
5 best practices, policies, protocols, and procedures in order
6 that they ascertain domestic violence and sexual assault
7 awareness in the workplace, assist affected employees, and
8 provide a safe and helpful working environment for employees
9 currently or potentially experiencing the effects of domestic
10 violence or sexual assault. The model plan shall include but
11 not be limited to:
12 (1) the establishment of a definite corporate policy
13 statement recognizing domestic violence and sexual
14 assault as workplace issues as well as promoting the need
15 to maintain job security for those employees currently
16 involved in domestic violence or sexual assault disputes;
17 (2) policy and service publication requirements,
18 including posting these policies and service availability
19 pamphlets in break rooms, on bulletin boards, and in
20 restrooms, and transmitting them through other
21 communication methods;
22 (3) a listing of current domestic violence and
23 sexual assault community resources such as shelters,
24 crisis intervention programs, counseling and case
25 management programs, and legal assistance and advocacy
26 opportunities for affected employees;
27 (4) measures to ensure workplace safety including,
28 where appropriate, designated parking areas, escort
29 services, and other affirmative safeguards;
30 (5) training programs and protocols designed to
31 educate employees and managers in how to recognize,
32 approach, and assist employees experiencing domestic
33 violence or sexual assault, including both victims and
34 batterers; and

1 (6) other issues as shall be appropriate and
2 relevant for the task force in developing the model
3 policy.
4 (c) The model policy shall be reviewed by the task force
5 to assure consistency with existing law and shall be made the
6 subject of public hearings convened by the Department
7 throughout the State at places and at times which are
8 convenient for attendance by the public, after which the
9 policy shall be reviewed by the task force and amended as
10 necessary to reflect concerns raised at the hearings. If
11 approved by the task force, the model policy shall be
12 provided as approved with explanation of its provisions to
13 the Governor and the General Assembly not later than one year
14 after the effective date of this amendatory Act of the 91st
15 General Assembly. The Department shall make every effort to
16 notify businesses of the availability of the model domestic
17 violence and sexual assault employee awareness and assistance
18 policy.
19 (d) The Department, in consultation with the task force,
20 providers of services, the advisory council, the Department
21 of Labor, and representatives of statewide advocacy
22 organizations for the prevention of domestic violence and
23 sexual assault, shall provide technical support, information,
24 and encouragement to businesses to implement the provisions
25 of the model.
26 (e) Nothing contained in this Section shall be deemed to
27 prevent businesses from adopting their own domestic violence
28 and sexual assault employee awareness and assistance policy.
29 (f) The Department shall survey businesses within 4 years
30 of the effective date of this amendatory Act of the 91st
31 General Assembly to determine the level of model policy
32 adoption amongst businesses and shall take steps necessary to
33 promote the further adoption of such policy.".
