1 AN ACT in relation to dogs.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Animal Control Act is amended by adding
5 Section 16.1 and by changing Section 24 as follows:
6 (510 ILCS 5/16.1 new)
7 Sec. 16.1. Killing of a dog that attacks or injures a
8 person. Any person seeing a dog attack, injure, or wound any
9 other person without provocation or any person who is
10 personally attacked, injured, or wounded by a dog without
11 provocation may pursue and kill that dog at the time of the
12 attack if (i) the person who is attacked or injured is
13 peaceably conducting him or herself in any place where he or
14 she may lawfully be and (ii) the dog is not accompanied by or
15 not under the supervision of its owner or keeper.

17 Sec. 24. Nothing in this Act shall be construed or held
18 to limit in any manner the power of any municipality or other
19 political subdivision (i) to prohibit animals from running at
20 large, (ii) nor shall anything in this Act be construed to,
21 in any manner, limit the power of any municipality or other
22 political subdivision to further control and regulate dogs,
23 cats, or other animals in such municipality or other
24 political subdivision including a requirement of inoculation
25 against rabies, and (iii) to require the owners or keepers of
26 dogs found to be "vicious dogs" or "dangerous dogs" as
27 defined by Section 15 of this Act to have sufficient
28 liability insurance to respond to damages in any liability
29 thereafter incurred resulting from the keeping of a vicious
30 or dangerous dog, to register the vicious or dangerous dog

1 with the designated local agency, and to affirm by signature
2 that sufficient liability insurance is in force for that
3 animal.

5 Section 10. The Humane Care for Animals Act is amended
6 by changing Section 13 as follows:
7 (510 ILCS 70/13) (from Ch. 8, par. 713)
8 Sec. 13. Normal husbandry practices; conflict with other
9 Acts. Nothing in this Act affects normal, good husbandry
10 practices utilized by any person in the production of food,
11 companion or work animals, or in the extermination of
12 undesirable pests. In case of any alleged conflict between
13 this Act, or regulations adopted hereunder, and the Animal
14 Control Act, the "Wildlife Code, of Illinois" or the Humane
15 Slaughter of Livestock Act "An Act to define and require the
16 use of humane methods in the handling, preparation for
17 slaughter, and slaughter of livestock for meat or meat
18 products to be offered for sale", approved July 26, 1967, as
19 amended, the provisions of those Acts shall prevail.

21 Section 99. Effective date. This Act takes effect upon
22 becoming law.
