1 AN ACT regarding mental health services planning
2 councils.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 1. Short title. This Act may be cited as the
6 Local Mental Health Services Planning Council Act.
7 Section 5. Purpose. The purpose of this Act is to
8 facilitate the creation and maintenance of a coordinated
9 system of care for persons with mental illness and to provide
10 the Department, the Joint Advisory Council, and the
11 administrators of local mental health networks within the
12 Department with advice and consultation from providers of and
13 primary and secondary consumers of mental health services.
14 Section 10. Definitions. As used in this Act:
15 "Department" means the Department of Human Services.
16 "Joint Advisory Council" means the Joint Advisory Council
17 of the Mental Health Services System, the State mental health
18 planning council required by 42 USC 300x-3.
19 Section 15. Creation and composition of local councils.
20 The Department shall create at least 30 but no more than 50
21 local mental health services planning councils. The
22 Department shall determine the geographic area to be served
23 by each local council and insure that the entire State is
24 within a geographic area served by a local council. Each
25 local council shall be comprised of between 11 and 19 members
26 appointed by the Department within 90 days after the
27 effective date of this Act. The Department shall consult
28 with organizations which provide services to persons with
29 mental illness, State-wide and local organizations of

1 professionals who serve persons with mental illness, and
2 State-wide and local groups who advocate for persons with
3 mental illness prior to appointing members of each local
4 council. No member of a local council shall be employed by
5 the Department. Each local council shall be comprised of
6 persons with mental illness, family members of persons with
7 mental illness, persons involved in providing services to
8 persons with mental illness, and advocates for persons with
9 mental illness. At least one half of the members shall be
10 persons who do not provide mental health services to persons
11 with mental illness and who are not employed by or agents of
12 any organization which provides mental health services. At
13 least 10% of the members of each local council shall be
14 persons with mental illness. Each member of the local
15 council shall either reside in the geographic area served by
16 the local council or provide services in that geographic
17 area. Members of each local council shall serve without pay.
18 Section 20. Council procedures. Each local council
19 shall determine how frequently it shall meet, provided that
20 each local council meets at least 6 times a year. Notice of
21 meetings shall be provided in a timely fashion to each
22 member. Each local council shall be subject to the
23 provisions of the Open Meetings Act. The Department shall
24 designate one or more employees who have administrative
25 responsibilities for providing mental health services in the
26 geographic area served by each local council to attend each
27 meeting of a local council. Each local council shall keep
28 records of its proceedings which records include attendance
29 at meetings and the results of any votes. The Department
30 shall provide such funds as are needed to cover the costs of
31 photocopying, postage, and other expenses incidental to the
32 operation of each local council.

1 Section 25. Duties of local councils.
2 (a) Each year, the Department shall present its plan for
3 delivering mental health services in each geographic area to
4 the local council which serves that area. The local council
5 shall provide the Department with advice concerning the
6 appropriateness of the plan. Any plan to change
7 substantially the services provided or funded by the
8 Department in a geographic area shall be submitted to the
9 local council for that area for its comments and advice
10 before the plan is implemented. A substantial change
11 includes the following:
12 (i) closing a mental health facility or any ward or
13 subdivision of a mental health facility;
14 (ii) creation or elimination of any program
15 providing mental health services; and
16 (iii) an increase or decrease of 10% in the funding
17 for any mental health program or service.
18 (b) At least once a year, each local council shall
19 provide a written report to the Joint Advisory Council which
20 report shall include suggestions for improvements in the
21 overall design of the mental health system in Illinois and
22 the priorities for services within that system. The Joint
23 Advisory Council shall collate these reports and provide a
24 comprehensive report to the Department, the Speaker and
25 Minority Leader of the House, and the President and Minority
26 Leader of the Senate. Copies of the comprehensive report
27 shall be provided to each local council.
28 Section 30. Rules and bylaws. The Department shall
29 promulgate rules governing the creation, composition, and
30 functioning of the local councils consistent with the
31 provisions of this Act. Each local council shall adopt
32 bylaws consistent with the rules promulgated by the
33 Department and the provisions of this Act.

1 Section 35. Exemption for areas with community mental
2 health boards. Nothing contained in this Act shall apply to
3 any area of the State in which a community mental health
4 board has been established pursuant to the provisions of the
5 Community Mental Health Act.
6 Section 99. Effective date. This Act takes effect upon
7 becoming law.
