1 AN ACT to amend the Election Code by changing Section
2 6A-3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Election Code is amended by changing
6 Section 6A-3 as follows:
7 (10 ILCS 5/6A-3) (from Ch. 46, par. 6A-3)
8 Sec. 6A-3. If the county board adopts an ordinance
9 providing for the establishment of a county board of election
10 commissioners, or if a majority of the votes cast on a
11 proposition submitted in accordance with Section 6A-2 are in
12 favor of a county board of election commissioners, a county
13 board of election commissioners shall be appointed in the
14 same manner as is provided in Article 6 for boards of
15 election commissioners in cities, villages and incorporated
16 towns. Upon the effective date of this amendatory Act of
17 1999, after the expiration of the term of each commissioner,
18 appointments shall be made by the chairman of the county
19 board with the advice and consent of the county board. If
20 the office of any commissioner shall become vacant, it shall
21 thereupon be the duty of such chairman of the county board to
22 appoint within 60 days a successor for such unexpired term;
23 within 60 days after the expiration of the term for which
24 each commissioner is appointed such chairman of the county
25 board shall, in the same way, appoint a successor, who shall
26 hold his or her office for the period of 3 years, and until
27 his or her successor is appointed. However, before any
28 appointments are made, the appointing authority shall
29 ascertain whether the county clerk desires to be a member of
30 the county board of election commissioners. If the county
31 clerk so desires, he shall be one of the members of the

1 county board of election commissioners, and the appointing
2 authority shall appoint only 2 other members.
3 Section 99. Effective date. This Act shall take effect
4 upon becoming law.
