1 AN ACT concerning products with recycled contents.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Recycled Content Products Study Act.
6 Section 5. Recycled Content Products Task Force.
7 (a) There is established the Recycled Content Products
8 Task Force. The Task Force shall consist of the following
9 members:
10 (1) the Lieutenant Governor or his or her designee;
11 (2) the Director of Commerce and Community Affairs
12 or his or her designee;
13 (3) two members of the Senate appointed one each by
14 the President of the Senate and the Minority Leader of
15 the Senate;
16 (4) two members of the House of Representatives
17 appointed one each by the Speaker of the House and the
18 Minority Leader of the House; and
19 (5) ten members appointed by the Governor as
20 follows:
21 (A) one member from a local solid waste
22 agency;
23 (B) one member representing a manufacturer
24 using recycled content in products;
25 (C) one member representing a nonprofit
26 recycling center;
27 (D) one member who is an executive of a solid
28 waste company;
29 (E) one member representing a recycling
30 processing company;
31 (F) one member representing a research

1 institution or an institution of higher education;
2 (G) one member representing consumer advocacy
3 groups;
4 (H) two members representing environmental
5 advocacy groups; and
6 (I) one member representing municipalities.
7 Appointments shall be made by October 1, 1999.
8 (b) The Director of Commerce and Community Affairs or
9 the Director's designee shall serve as chairman of the Task
10 Force. Members of the Task Force shall serve without
11 compensation, but may be reimbursed for their reasonable and
12 necessary expenses incurred in performing their duties. The
13 Department of Commerce and Community Affairs shall provide
14 staff and equipment necessary for the Task Force to complete
15 its duties.
16 Section 10. Task Force study.
17 (a) The Task Force shall study and assess the existing
18 market development for recycled content products in the
19 private and public economy. The Task Force shall compare
20 this market in Illinois with the markets in other Midwestern
21 states.
22 (b) The Task Force shall evaluate the desirability of
23 implementing market development approaches in use in other
24 Midwestern states, including, but not limited to, the
25 desirability of:
26 (1) creating a State Marketing Board to act in the
27 role of supporting market efforts for use of recyclables
28 in existing or new products and advising State and local
29 officials in recyclable marketing efforts;
30 (2) creating technical assistance programs,
31 utilizing universities and other research organizations,
32 designed to assist local governments and businesses with
33 incorporation of recyclables into product development;

1 (3) incentives through loans or grants to encourage
2 the use of recyclables in existing or new products;
3 (4) tax credits under circumstances when resource
4 commitment and product development goals have been met
5 through the use of recyclables; and
6 (5) establishment of a local zone program having as
7 its purpose the promotion of recycling manufacturing
8 businesses in cooperation with local governments.
9 (c) "Local zone program" means a program designed to
10 compliment State market development and business assistance
11 efforts by offering additional services and incentives such
12 as fast track permitting, location incentives, and job
13 training assistance.
14 Section 15. Recycled product purchase programs.
15 (a) The Task Force shall consider the appropriateness of
16 developing an ongoing educational effort designed to promote
17 understanding of the economic desirability of the purchase
18 and use of recycled content products by government,
19 businesses, and individuals.
20 (b) The Task Force shall consider the efficacy of
21 promoting the purchase and use of recycled content products
22 by State and local governmental entities through procurement
23 and implementation policies.
24 (c) The Task Force shall consider whether the State
25 should participate in interstate joint purchasing agreements
26 for recycled content products in a manner that will enable
27 municipalities to participate in such a program.
28 Section 20. Report. The Task Force shall report its
29 findings and recommendations to the Governor and General
30 Assembly no later than July 1, 2000.
31 Section 99. Effective date. This Act takes effect upon
