1 AN ACT to amend the Wastewater Land Treatment Site
2 Regulation Act by changing Section 3.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Wastewater Land Treatment Site Regulation
6 Act is amended by changing Section 3 as follows:
7 (415 ILCS 50/3) (from Ch. 111 1/2, par. 583)
8 Sec. 3. Engineering report; financial responsibility
9 ordinance.
10 (a) An applicant for a wastewater land treatment site
11 located inside of the county in which the waste was produced
12 shall submit its engineering report for concept approval,
13 including proof of financial capability to operate and
14 maintain such a system on a continuing basis, concurrently to
15 the Illinois Environmental Protection Agency and any
16 designated management agency in the facility planning area
17 within which the system is located, and to any designated
18 area-wide water quality planning agency within which the
19 system is located.
20 (b) In addition, an applicant seeking a permit to
21 establish, operate, manage, or maintain a lagoon treatment
22 spray irrigation system to be located in a county having a
23 common boundary with the northern line of the State of
24 Illinois and a population of at least 500,000 but less than
25 2,000,000 shall secure from the municipality within which the
26 system is proposed to be located, or from the county if the
27 system is proposed to be located in an unincorporated area, a
28 plan approved in the form of an ordinance adopted by the
29 corporate authorities of the municipality or county under
30 which the municipality or county accepts operating and
31 financial responsibility for the spray irrigation system in

1 the event of its malfunction or failure.
2 A copy of the adopted ordinance must be submitted to the
3 Illinois Environmental Protection Agency, to any designated
4 management agency in the facility planning area within which
5 the system is proposed to be located, and to any designated
6 areawide water quality planning agency within whose
7 jurisdiction the system is proposed to be located.
8 The Illinois Environmental Protection Agency shall not
9 issue a permit to establish, operate, manage, or maintain a
10 lagoon treatment spray irrigation system to be located in a
11 county having a common boundary with the northern line of the
12 State of Illinois and a population of at least 500,000 but
13 less than 2,000,000, unless a copy of the required ordinance
14 has been submitted to the Agency, notwithstanding the
15 applicant's compliance with all other requirements for the
16 permit.
17 (c) A designated management agency may review and
18 comment to the Illinois Environmental Protection Agency
19 regarding such engineering report and ordinance, if any.
20 Such review and comment must be submitted to the Illinois
21 Environmental Protection Agency within 45 days of submission
22 of the engineering report. The Illinois Environmental
23 Protection Agency shall consider such review and comment in
24 its permit issuance process.

26 Section 99. Effective date. This Act takes effect upon
