1 AN ACT to create the Managed Care Patient Bill of Rights
2 Act.
3 WHEREAS, Patients should have the right to seek emergency
4 care without prior approval; and
5 WHEREAS, Patients should have the right to appeal
6 treatment decisions and other grievances in a timely manner
7 and have access to an independent, unbiased review process
8 for unresolved disputes; and
9 WHEREAS, Patients should have the right to a meaningful
10 choice regarding primary and specialty care physicians; and
11 WHEREAS, Patients should have the right to be informed by
12 physicians about all treatment options available, which means
13 that "gag" rules are unacceptable, and health care providers
14 must be free to discuss treatment options with their
15 patients; and
16 WHEREAS, Patients should have the right to get accurate,
17 readable information about primary, emergency, and
18 specialized services, hospitals, doctors, and coverage rules
19 to allow them to make decisions that fit their needs, and
20 this process should include the creation of a statewide
21 managed care "report card" developed by the State with
22 independent information; and
23 WHEREAS, Patients should have the right to be notified on
24 a timely basis when care is denied; and
25 WHEREAS, Patients should have the right to treatment
26 decisions made by physicians, not bureaucrats; and
27 WHEREAS, Patients should have the right to be able to
28 expect that once a managed care firm makes a decision to
29 provide treatment, the original decision will not be
30 overturned later in the treatment process; and

1 WHEREAS, Patients should have the right to be able to
2 expect that their medical records will be kept confidential;
3 therefore
4 Be it enacted by the People of the State of Illinois,
5 represented in the General Assembly:
6 Section 1. Short title. This Act may be cited as the
7 Managed Care Patient Bill of Rights Act.
