3 ON SENATE BILL 1202

6 To the President of the Senate and the Speaker of the
7 House of Representatives:
8 We, the conference committee appointed to consider the
9 differences between the houses in relation to House Amendment
10 No. 1 to Senate Bill 1202, recommend the following:
11 (1) that the Senate concur in House Amendment No. 1; and
12 (2) that Senate Bill 1202 be further amended as follows:
13 by replacing the title with the following:
14 "AN ACT in relation to local government officers."; and
15 in Section 5, in the introductory clause, by replacing
16 "3-3009 and 3-3010" with "3-3009, 3-3010, 5-1103.1, and
17 5-5001"; and
18 in Section 5, below Sec. 3-3010, by inserting the following:
19 "(55 ILCS 5/5-1103.1) (from Ch. 34, par. 5-1103.1)
20 Sec. 5-1103.1. Contract for police protection. In
21 counties having fewer than 1,000,000 inhabitants, the county
22 board may contract, with advice and consent of the sheriff in
23 the county in which the request for contract services is
24 made, based upon a determination of law enforcement needs of
25 the area in which contract services are sought, with one or
26 more incorporated municipalities lying wholly or partly
27 within the county to furnish police protection in the area of
28 the county that is not within the incorporated area of any
29 municipality having a regular police department.

1 Sec. 5-5001. Police protection in townships outside
2 incorporated municipalities. The county board of any county
3 may contract, with advice and consent of the sheriff in the
4 county in which the request for contract services is made,
5 based upon a determination of law enforcement needs of the
6 area in which contract services are sought, with any township
7 in the county to furnish police protection outside of any
8 incorporated municipality in the township.

10 below Section 5, by inserting the following:
11 "Section 10. The Township Code is amended by changing
12 Section 30-150 as follows:
13 (60 ILCS 1/30-150)
14 Sec. 30-150. Police protection by municipality; county
15 under 1,000,000. In counties having a population of less than
16 1,000,000, the electors may authorize the township board to
17 contract with one or more incorporated municipalities lying
18 wholly or partly within the boundaries of the township, or
19 with advice and consent of the sheriff in the county in which
20 the request for contract services is made, based upon a
21 determination of law enforcement needs of the area in which
22 contract services are sought with the county within which the
23 township is located to furnish police protection in the area
24 of the township that is not within the incorporated area of
25 any municipality having a regular police department.

27 Section 15. The Illinois Municipal Code is amended by
28 changing Section 11-1-7 as follows:
29 (65 ILCS 5/11-1-7) (from Ch. 24, par. 11-1-7)
30 Sec. 11-1-7. The corporate authorities of any

1 incorporated municipality, the boundaries of which are not
2 co-extensive with any township, may contract with any such
3 township in the county within which the municipality is
4 located to furnish police protection outside of the
5 incorporated municipality in such township.
6 The corporate authorities of any incorporated
7 municipality situated in a county of fewer than 1,000,000
8 inhabitants may contract, with advice and consent of the
9 sheriff in the county in which the request for contract
10 services is made, based upon a determination of law
11 enforcement needs of the area in which contract services are
12 sought, with the county in which the municipality is located
13 to furnish police protection in the county outside of the
14 incorporated municipality.
