1 AN ACT to amend the Illinois Vehicle Code by changing
2 Section 11-1301.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Vehicle Code is amended by
6 changing Section 11-1301 as follows:
7 (625 ILCS 5/11-1301) (from Ch. 95 1/2, par. 11-1301)
8 Sec. 11-1301. Stopping, standing or parking outside of
9 business or residence district.
10 (a) Outside a business or residence district, no person
11 shall stop, park or leave standing any vehicle, whether
12 attended or unattended, upon the roadway when it is
13 practicable to stop, park or so leave such vehicle off the
14 roadway, but in every event an unobstructed width of the
15 highway opposite a standing vehicle shall be left for the
16 free passage of other vehicles and a clear view of such
17 stopped vehicle shall be available from a distance of 200
18 feet in each direction upon such highway.
19 (b) The Department with respect to highways under its
20 jurisdiction or for the maintenance of which it is
21 responsible may place signs prohibiting or restricting the
22 stopping, standing or parking of vehicles on any highway
23 where in its opinion such stopping, standing or parking is
24 dangerous to those using the highway or where the stopping,
25 standing or parking of vehicles would unduly interfere with
26 the free movement of traffic thereon. Any such regulations
27 adopted by the Department regarding the stopping, standing or
28 parking of vehicles upon any specific street, streets or
29 highways become effective at the time of the erection of
30 appropriate signs indicating such regulations. Any such
31 signs may be erected either by the Department or by a local

1 authority with the approval of the Department.
2 (c) This Section, Section 11-1303 and Section 11-1304
3 shall not apply to the driver of any vehicle which is
4 disabled in such manner and to such extent that it is
5 impossible to avoid stopping and temporarily leaving the
6 vehicle in such position.
7 (d) Any second division vehicle used exclusively for the
8 collection of garbage, refuse, or recyclable material may
9 stop or stand on the road in a business or residential
10 district for the sole purpose of collecting garbage, refuse,
11 or recyclable material. The vehicle, in addition to having
12 its hazard lights lighted at all times that it is engaged in
13 stopping or standing, shall also use its amber oscillating,
14 rotating, or flashing light or lights as authorized under
15 paragraph 12 of subsection (b) of Section 12-215, if so
16 equipped.
