1 AN ACT in relation to tobacco.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the
5 Student Tobacco Use Prevention Act.
6 Section 5. Definitions. In this Act:
7 "Smokeless tobacco" means any tobacco products that are
8 suitable for dipping or chewing.
9 "Tobacco" means cigars, cigarettes, smokeless tobacco, or
10 tobacco in any of its forms.
11 "Tobacco settlement agreement" means the Master
12 Settlement Agreement in the case of People of the State of
13 Illinois v. Philip Morris, Inc. et al. (Circuit Court of Cook
14 County, Case No. 96-L13146). The term also includes any
15 settlement with or judgment against a tobacco product
16 manufacturer not participating in that Master Settlement
17 Agreement, if the settlement or judgment is in satisfaction
18 of a released claim as that term is defined in the Master
19 Settlement Agreement.
20 Section 10. Grants to school districts.
21 (a) The State Board of Education shall administer a
22 program of grants to school districts to implement local
23 programs designed to encourage abstinence from the use of
24 tobacco or cessation of the use of tobacco, or both, by
25 students in elementary and secondary schools.
26 (b) School districts may apply to the State Board of
27 Education for a grant under this Section. The State Board
28 of Education shall adopt rules specifying the manner and form
29 for applications as well as the criteria for awarding
30 grants.

1 (c) Subject to appropriations for that purpose, the State
2 Board of Education shall award grants to school districts
3 under this Section.
4 (d) Funding for the grant program under this Section
5 shall come from moneys received by the State pursuant to a
6 tobacco settlement agreement.
7 Section 15. Reports.
8 (a) Each school district that receives a grant under
9 Section 10 shall submit to the State Board of Education a
10 report accounting for the district's expenditures of the
11 grant moneys and summarizing its program's results. The
12 report shall be submitted in a form and at a time determined
13 by the State Board of Education by rule.
14 (b) Not later than June 30 of each year, the State Board
15 of Education shall submit to the Governor and the General
16 Assembly a report that summarizes the school district reports
17 submitted to the State Board of Education under subsection
18 (a) for the preceding fiscal year.
19 Section 99. Effective date. This Act takes effect upon
20 becoming law.
