1 Senate Joint Resolution No. 69
2 (As amended by Senate Amendment No. 1)
3 WHEREAS, The Illinois Health Facilities Planning Act was
4 created in 1974, in accordance with federal mandates, to
5 establish a procedure to reverse the trend of increasing
6 health care costs resulting from unnecessary construction or
7 modification of health care facilities, to improve the
8 financial ability of the public to obtain necessary health
9 services, and to establish an orderly and comprehensive
10 health care delivery system providing quality health care;
11 and
12 WHEREAS, The Health Facilities Planning Board currently
13 administers the Certificate of Need program for the
14 regulation of ambulatory surgical treatment centers,
15 hospitals, nursing homes, and kidney disease treatment
16 centers within the State of Illinois; and
17 WHEREAS, The health care delivery system has undergone
18 drastic changes and witnessed numerous advancements in the
19 past 25 years; and
20 WHEREAS, Thirteen states have repealed their Certificate
21 of Need programs and many other states have scaled back their
22 Certificate of Need programs by limiting the scope and
23 criteria for review under those programs; and
24 WHEREAS, Very few legislative changes have been made to
25 the Illinois Health Facilities Planning Act since its
26 inception; therefore, be it
27 RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL
28 ASSEMBLY OF THE STATE OF ILLINOIS, THE HOUSE OF
29 REPRESENTATIVES CONCURRING HEREIN, that there is created the
30 Illinois Legislative Task Force on Certificate of Need
31 consisting of 5 voting members; one of whom shall be a member
32 of the Senate appointed by the President of the Senate and

1 who shall serve as Co-chairperson, one of whom shall be a
2 member of the Senate appointed by the Minority Leader of the
3 Senate, one of whom shall be a member of the House of
4 Representatives appointed by the Speaker of the House of
5 Representatives and who shall serve as Co-chairperson, one of
6 whom shall be a member of the House of Representatives
7 appointed by the Minority Leader of the House of
8 Representatives, and one of whom shall be a consumer who is
9 not a member of the Health Facilities Planning Board and who
10 will be appointed jointly by the Co-chairpersons of the Task
11 Force; and be it further
12 RESOLVED, That the Task Force shall include 9 non-voting
13 members; one of whom shall be a representative designated by
14 the Illinois Hospital and Health Systems Association, one of
15 whom shall be a representative designated by the Illinois
16 State Medical Society, one of whom shall be a representative
17 designated by the Life Services Network, one of whom shall be
18 a representative designated by the Illinois Health Care
19 Association, one of whom shall be a representative designated
20 by the Illinois Council on Long Term Care, one of whom shall
21 be a representative designated by the Chamber of Commerce,
22 one of whom shall be a representative designated by the
23 Illinois Freestanding Surgery Center Association, one of whom
24 shall be a consumer who is not a member of the Health
25 Facilities Planning Board and who will be appointed jointly
26 by the Co-chairpersons of the Task Force, and one of whom
27 shall be a member of the Health Facilities Planning Board;
28 and be it further
29 RESOLVED, That the meetings of the Task Force shall be
30 held at the call of the Co-chairpersons and that members of
31 the Task Force shall serve without compensation; and be it
32 further
33 RESOLVED, That the Task Force shall study the Certificate

1 of Need process; and be it further
2 RESOLVED, That the Task Force shall report its
3 recommendations to the General Assembly and Governor on or
4 before January 9, 2001.
