1 SENATE RESOLUTION
2 WHEREAS, In 1996, the federal government relinquished its
3 responsibility in the $50 pass through program with the
4 passage of the Personal Responsibility and Work Opportunity
5 Reconciliation Act of 1996; and
6 WHEREAS, The State of Illinois led the nation in electing
7 to continue the $50 pass through at a cost to the State of
8 Illinois of $8.9 million in FY99; and
9 WHEREAS, Federal law requires Illinois to send 50% of
10 child support collected on behalf of families receiving TANF
11 to the federal government to compensate for Medicaid and
12 other federal programs provided to the families; and
13 WHEREAS, This policy restricts Illinois' ability to
14 manage and redistribute child support collections; and
15 WHEREAS, The federal government has provided to Wisconsin
16 a waiver with respect to Wisconsin's obligation to pay the
17 federal share of child support collections, allowing the
18 state to pass through 100% of child support collected on
19 behalf of TANF recipients to those recipients; and
20 WHEREAS, Maintaining State control of child support
21 collections would enable Illinois to pass through a greater
22 amount of collections to TANF recipients, thus aiding in the
23 goal of moving families from welfare to self-sufficiency;
24 therefore, be it
25 RESOLVED, BY THE SENATE OF THE NINETY-FIRST GENERAL
26 ASSEMBLY OF THE STATE OF ILLINOIS, that we urge Congress to
27 revise the distribution of collected child support as
28 required under 42 USC 657(a)(1) so as to remove disincentives
29 placed on states that wish to establish pass through
30 programs; and be it further

1 RESOLVED, That a suitable copy of this resolution be
2 delivered to the Governor, members of the Illinois
3 congressional delegation, the Secretary of the Department of
4 Human Services, and the Director of the Department of Public
5 Aid.
