violation of the Americans with Disabilities Act (ADA); and
WHEREAS, Pursuant to the Supreme Court's ruling, the U.S.
Department of Health and Human Services (HHS) has issued
guidelines to the states on how to make state programs
responsive to persons with disabilities who wish to live in
the most integrated setting appropriate; and
WHEREAS, In providing for its citizens with disabilities,
a state must provide community-based services for persons
with disabilities otherwise entitled to institutional
services when the state's treatment professionals determine
that community placement is appropriate, provided that the
person with a disability chooses community-based services;
and
WHEREAS, In Olmstead, the Supreme Court ruled that a

comprehensive effective working plan for placing qualified
persons with disabilities in less restrictive settings with
appropriate support services; and
WHEREAS, It is critical to the success of Illinois'

members, organizations representing persons with disabilities
and providers of services to persons with disabilities,
