    Sec. 12-4.13a. Gross income eligibility standard; SNAP. Subject to federal approval if required, a household that includes an elderly, blind, or disabled person shall be considered categorically eligible for Supplemental Nutrition Assistance Program (SNAP) benefits if the gross income of such household is at or below 200% of the nonfarm income poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2); and a household that does not include an elderly, blind, or disabled person shall be considered categorically eligible for Supplemental Nutrition Assistance Program (SNAP) benefits if the gross income of such household is at or below 165% of those nonfarm income poverty guidelines.

    Sec. 12-4.13a. Gross income eligibility standard; SNAP.
    (a) Subject to federal approval if required, a household that includes an elderly, blind, or disabled person shall be considered categorically eligible for Supplemental Nutrition Assistance Program (SNAP) benefits if the gross income of such household is at or below 200% of the nonfarm income poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services under the authority of 42 U.S.C. 9902(2); and a household that does not include an elderly, blind, or disabled person shall be considered categorically eligible for Supplemental Nutrition Assistance Program (SNAP) benefits if the gross income of such household is at or below 165% of those nonfarm income poverty guidelines.
    (b) Subject to federal approval, if required, and federal funding, a household that includes one or more veterans or members of the armed forces shall be considered categorically eligible for Supplemental Nutrition Assistance Program (SNAP) benefits if the gross income of such a household is at or below 200% of the nonfarm income poverty guidelines. Nothing in this subsection shall be construed to create an obligation on the part of the Department of Human Services to allocate or provide SNAP benefits through the use of State funds.
    As used in this subsection:
    "Armed forces" means any of the Armed Forces of the United States, including a member of any reserve component or National Guard unit.
    "Veteran" means a person who has served in the armed forces and was discharged or separated under honorable conditions.
