Section 217.805 Emission Unit Eligibility
Any owner or operator of a stationary source may submit a proposal, as provided in Section 217.835 of this Subpart, for voluntarily reducing NOx emissions during the control period, if each emission unit from which NOx reductions at the source will be obtained meets the following criteria:
a) Discharges through a stack;
b) Is fossil fuel-fired;
c) Is not subject to the requirements of Subparts T, U, V or W of this Part;
d) Is not a retired unit pursuant to 40 CFR 96.5;
e) Has not elected to become an opt-in unit pursuant to Section 217.754 or Section 217.774 of this Part; and
f) Is not a stationary internal combustion engine that emits more than one ton of NOx per day during the ozone control period.
