Section 250.2880 Patient Legal and Human Rights
a) Restraints shall not be used in substance use disorder treatment programs except in accordance with Section 6.20 of the Act and Section 250.1075 of this Part. Restraints shall be used only as a therapeutic measure to prevent a patient from causing physical harm to themself or others. In no event shall restraints be utilized to punish or discipline a patient or as a convenience for the staff. The hospital shall have written policies for the use of restraints in accordance with Section 250.2280(c).
b) Substance use disorder programs shall not exclude patients who require special care for mental illness, intellectual disability or major physical disability.
c) Any restriction by sex, age or geographic area shall be clearly stated and shall be applied to all applicants.
