    AN ACT concerning State government.
 
    Be it enacted by the People of the State of Illinois, 
represented in the General Assembly: 
 
    Section 5. Property. In consideration of the lands 
reserved for Chief Shab-eh-nay by the Treaty of Prairie du 
Chien of July 29, 1829, as well as the Prairie Band Potawatomi 
Nation's historic connection to those lands and the 
surrounding area, the Director of Natural Resources, on behalf 
of the State of Illinois, is authorized to execute and deliver 
to the Prairie Band Potawatomi Nation, for and in 
consideration of $1 paid to the Department of Natural 
Resources, a quit claim deed to the following described real 
property comprising all of the lands within Shabbona Lake and 
State Park, located in DeKalb County, owned by the State of 
Illinois:

Conservation by Deed dated November 1, 1972, and recorded 
November 30, 1972, in the Recorder's Office of DeKalb County, 
Illinois, as Document Number 369532, described as follows:
    PARCEL 1
    That part of the South Half of Lot 11 in the Northwest 
    Quarter of Section 25, Township 38 North, Range 3 East of 
    the Third Principal Meridian, lying Northwesterly of a 
    line parallel with and distant 75 feet Northwesterly, 
    measured at right angles, from the center line of the main 
    track of the Northern Illinois Railway Company (now the 
    Chicago and North Western Transportation Company), as said 
    main track center line was originally located and 
    established over and across said Section 25.

    Section 10. Conveyance. 
    (a) Subject to the conditions set forth in subsections 
(b), (c), and (d), the Director of Natural Resources, on 
behalf of the State of Illinois and the Department of Natural 
Resources, shall convey by quit claim deed all right, title, 
and interest of the State of Illinois and the Department of 
Natural Resources in and to the real property described in 
Section 5 to the Prairie Band Potawatomi Nation.
    (b) The conveyance of real property authorized by Section 
5 shall be made so long as the conveyance to the Prairie Band 
Potawatomi Nation does not violate any federal funding 
restrictions, nor violate the terms of any federal grant, nor 
require the Department to reimburse, refund, or provide 
replacement land to the federal government (U.S. Fish and 
Wildlife Service, National Park Service, or the U.S. 
Department of the Interior) for federal grant funds awarded to 
the Department to acquire property, construct infrastructure 
and enhance the natural habitat or provide recreational 
opportunities for public use at the Shabbona Lake and State 
Park.
    (c) The conveyance of real property authorized by Section 
5 shall be made so long as the Department of Natural Resources 
and the Prairie Band of the Potawatomi Nation enter into a land 
management agreement pursuant to Section 3b of the State Parks 
Act.
    (d) The conveyance of real property authorized by Section 
5 shall be made subject to existing public utilities, existing 
public roads, and any and all reservations, easements, 
encumbrances, licenses, covenants, and restrictions of record.
 
    Section 15. Recording. The Director of Natural Resources 
shall obtain a certified copy of this Act within 60 days after 
its effective date. The Department of Natural Resources shall 
ensure that a certified copy of this Act and any quit claim 
deed executed pursuant to this Act that is provided to the 
Prairie Band Potawatomi Nation shall be recorded by the 
Prairie Band Potawatomi Nation in the Recorder's Office of the 
county in which the land is located.
 
    Section 90. The State Parks Act is amended by adding 
Section 3b as follows:
 
    (20 ILCS 835/3b new)
    Sec. 3b. Shabbona Lake and State Park; land management 
agreement.
    (a) The Department of Natural Resources may enter into a 
land management agreement with the Prairie Band Potawatomi 
Nation and other necessary parties for the purpose of 
managing, maintaining, or operating the real property conveyed 
to the Prairie Band Potawatomi Nation by this amendatory Act 
of the 103rd General Assembly. Any such agreement shall 
contain the purpose, powers, rights, objectives, and 
responsibilities of each contracting party and a requirement 
that the land conveyed by this amendatory Act of the 103rd 
General Assembly remain open for public recreation during the 
term of any such agreement. All agreements entered into 
pursuant to this Section shall be subject to the written 
approval of the Director of Natural Resources.
    (b) Subject to appropriation, the Department of Natural 
Resources may use State resources for the management, 
maintenance, and operation of the real property conveyed to 
the Prairie Band Potawatomi Nation by this amendatory Act in 
accordance with the land management agreement that it executes 
with the Prairie Band Potawatomi Nation under this Section.
    (c) In this Section, "land management agreement" means one 
or more agreements, or set of agreements, made for the purpose 
of managing, maintaining, or operating the real property 
conveyed to the Prairie Band Potawatomi Nation by this 
amendatory Act of the 103rd General Assembly.
 
    Section 99. Effective date. This Act takes effect upon 
becoming law.
