    AN ACT concerning public health.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Department of Public Health Powers and
Duties Law of the Civil Administrative Code of Illinois is
amended by adding Section 2310-323 as follows:

    Sec. 2310-323. Advisory Council on Youth HIV/AIDS
Prevention Messages.
    (a) Subject to appropriation, there is created the Advisory
Council on Youth HIV/AIDS Prevention Messages to advise the
Department on effective prevention messages designed to
educate and deter youth from engaging in risky behaviors that
could result in the transmission of HIV/AIDS.
    (b) The Advisory Council shall consist of all of the
following members:
        (1) One member of the Senate appointed by the President
    of the Senate and one member of the Senate appointed by the
    Minority Leader of the Senate.
        (2) One member of the House of Representatives
    appointed by the Speaker of the House of Representatives
    and one member of the House of Representatives appointed by
    the Minority Leader of the House of Representatives.
        (3) Five members appointed by the Governor as follows:
            (A) One representative of a social service agency
        that provides services to youth and families infected
        or impacted by HIV/AIDS.
            (B) One person from academia with a background or
        expertise in HIV/AIDS prevention messages.
            (C) One representative of the Department of Human
        Services.
            (D) One person with a background in public health.
            (E) One youth member 18 years old or older and
        under 24 years.
        (4) The public information officer of the Department of
    Public Health, who shall be a non-voting member of the
    Advisory Council.
    Each voting member shall serve for a term of 3 years and
until his or her successor is appointed and has qualified.
Vacancies shall be filled in the same manner as original
appointments.
    (c) The Advisory Council shall meet to organize and select
a chairperson upon appointment of a majority of the members.
The chairperson shall be elected by a majority vote of the
members appointed to the Advisory Council. The Advisory Council
shall meet at least 4 times a year at the call of the
chairperson. Members of the Advisory Council shall serve
without compensation, but may be reimbursed for reasonable
expenses incurred as a result of their duties as members of the
Advisory Council from funds appropriated by the General
Assembly for that purpose.
    (d) The Advisory Council shall submit an annual report to
the Department on or before July 1, 2010 and on or before July
1 of each year thereafter with recommendations for effective
prevention messages aimed at youth, including recommendations
regarding the use of technology to deliver such messages.
 
    Section 99. Effective date. This Act takes effect upon
becoming law.
