AN ACT concerning local government.
|
Be it enacted by the People of the State of Illinois,
|
represented in the General Assembly:
|
Section 5. The Illinois Municipal Code is amended by adding |
Section 11-6-7 as follows:

Sec. 11-6-7. Annexation; intergovernmental agreement. |
(a) Whenever an unincorporated parcel of land that is |
within the boundaries of a fire protection district is annexed |
into the corporate limits of a municipality with a municipal |
fire department, the municipal fire department and the fire |
protection district may negotiate an intergovernmental |
agreement to allow the fire protection district to have |
jurisdiction over the annexed parcel in such instances when it |
is not economically feasible for the municipal fire department |
to have jurisdiction over the annexed property or when the |
municipal fire department has determined that a hardship exists |
that would compromise the safety and well-being of the annexed |
property. If no agreement is adopted by both the municipality |
and fire protection district, then the automatic transfer of |
jurisdiction from the fire protection district to the |
municipality shall occur upon annexation. |
(b) This Section is repealed 12 months after becoming law, |
