    AN ACT concerning safety.
 
    Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
 
    Section 5. The Illinois Underground Utility Facilities
Damage Prevention Act is amended by changing Section 14 as
follows:

    Sec. 14. Home rule. The regulation of underground utility
facilities and CATS facilities damage prevention, as provided
for in this Act, is an exclusive power and function of the
State. A home rule unit may not regulate underground utility
facilities and CATS facilities damage prevention, as provided
for in this Act. All units of local government, including home
rule units that are not municipalities of more than 1,000,000
persons, must comply with the provisions of this Act. To this
extent, this This Section is a denial and limitation of home
rule powers and functions under subsection (h) of Section 6 of
Article VII of the Illinois Constitution. A home rule
municipality of more than 1,000,000 persons may regulate
underground utility facilities and CATS facilities damage
prevention.

    Section 99. Effective date. This Act takes effect upon
becoming law.
