1 | | or other local governmental entity in which the solicitation |
2 | | takes
place shall determine by ordinance where and when |
3 | | solicitations may take place
based on the safety of the |
4 | | solicitors and the safety of motorists. The
decision shall also |
5 | | take into account the orderly flow of traffic and may not
allow |
6 | | interference with the operation of official traffic control |
7 | | devices. The
soliciting agency shall be:
|
8 | | 1. registered with the Attorney General as a charitable |
9 | | organization as
provided by "An Act to regulate |
10 | | solicitation and collection of funds for
charitable |
11 | | purposes, providing for violations thereof, and making an
|
12 | | appropriation therefor", approved July 26, 1963, as |
13 | | amended;
|
14 | | 2. engaged in a Statewide fund raising activity; and
|
15 | | 3. liable for any injuries to any person or property |
16 | | during the
solicitation which is causally related to an act |
17 | | of ordinary negligence of the
soliciting
agent.

18 | | Any person engaged in the act of solicitation under an |
19 | | ordinance shall be 16 years of age
or more and shall be wearing |
20 | | a high visibility vest.
|
21 | | (d) No person shall stand on or in the proximity of a |
22 | | highway for the
purpose of soliciting the watching or guarding |
23 | | of any vehicle while parked
or about to be parked on a highway.
|
24 | | (e) Every person who is convicted of a violation of this |
25 | | Section shall
be guilty of a Class A misdemeanor.
