AMENDMENT TO HOUSE BILL 531




2    AMENDMENT NO. ______. Amend House Bill 531 on page 1, by 
3inserting immediately below line 3 the following:
 
4    "Section 1. This Act may be referred to as the Daniel 
5Capuano Memorial Act."; and


 
6on page 2, by inserting immediately below line 1 the following:
7    "(a-5) This Section does not apply:
8        (1)  when the owner or manager of the commercial real 
9    estate within 14 days after receiving notice of the 
10    building code violation begins to have the commercial real 
11    estate repaired to comply with the building code and within 
12    that 14-day period posts signs warning of the danger to the 
13    public from the condition of the commercial real estate; or
14        (2)  if the commercial real estate is vacant and  the 
15    owner or manager places conspicuous signs on every entrance 
16    to the commercial real estate indicating that the

1    commercial real estate is abandoned and unsafe to a first 
2    responder. It is a defense to a violation of this Section 
3    that the signs were destroyed or stolen and that the owner 
4    or manager placed the signs as required by this paragraph 
5    (2) within the preceding 30 days.".
