| 1 | AN ACT concerning education.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The School Code is amended by changing Section | ||||||
| 5 | 14-1.09a and by adding Sections 10-20.60 and 34-18.53 as | ||||||
| 6 | follows: | ||||||
| 7 | (105 ILCS 5/10-20.60 new) | ||||||
| 8 | Sec. 10-20.60. School social worker. A school board may | ||||||
| 9 | employ school social workers who have graduated with a master's | ||||||
| 10 | or higher degree in social work from an accredited graduate | ||||||
| 11 | school of social work and have such additional qualifications | ||||||
| 12 | as may be required by the State Board of Education and who hold | ||||||
| 13 | a Professional Educator License with a school support personnel | ||||||
| 14 | endorsement for school social work pursuant to Section 21B-25 | ||||||
| 15 | of this Code. Only persons so licensed and endorsed may use the | ||||||
| 16 | title "school social worker". A school social worker may | ||||||
| 17 | provide individual and group services to the general student | ||||||
| 18 | population and to students with disabilities pursuant to | ||||||
| 19 | Article 14 of this Code and rules set forth in 23 Ill. Adm. | ||||||
| 20 | Code 226, Special Education, adopted by the State Board of | ||||||
| 21 | Education and may provide support and consultation to | ||||||
| 22 | administrators, teachers, and other school personnel | ||||||
| 23 | consistent with their professional qualifications and the | ||||||

| 1 | provisions of this Code and other applicable laws. School | ||||||
| 2 | districts may employ a sufficient number of school social | ||||||
| 3 | workers to address the needs of their students and schools and | ||||||
| 4 | may maintain the nationally recommended student-to-school | ||||||
| 5 | social worker ratio of 250 to 1. A school social worker may not | ||||||
| 6 | provide such services outside his or her employment to any | ||||||
| 7 | student in the district or districts that employ the school | ||||||
| 8 | social worker.

| 22 | services as provided in this Code and other applicable laws and | ||||||
| 23 | as which are limited to those services set
forth in 23 Ill. | ||||||
| 24 | Adm. Code 226, Special Education, pertaining to children
| ||||||
| 25 | between the ages of 3 to 21, promulgated by the State Board of | ||||||

| 1 | Education, governing the provision of special education and | ||||||
| 2 | related services to children with disabilities and | ||||||
| 3 | requirements for the treatment of children with disabilities | ||||||
| 4 | between the ages of 3 and 21.
School social workers may make | ||||||
| 5 | evaluations, recommendations or
interventions regarding the | ||||||
| 6 | placement of children in educational programs
or special | ||||||
| 7 | education classes. However, a school social worker shall not
| ||||||
| 8 | provide such services outside his or her employment to any | ||||||
| 9 | student in the
district or districts which employ such school | ||||||
| 10 | social worker.

| 12 | Section 99. Effective date. This Act takes effect upon | ||||||
| 13 | becoming law.
