AMENDMENT TO HOUSE BILL 1952

2    AMENDMENT NO. ______. Amend House Bill 1952 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Emergency Medical Services (EMS) Systems
5Act is amended by adding Section 3.88 as follows:
 
6    (210 ILCS 50/3.88 new)
7    Sec. 3.88. Ambulance assistance vehicle provider upgrades.
8    (a) As used in this Section:
9    "Ambulance assistance vehicle" has the meaning provided
10under 77 Ill. Adm. Code 515.825 and includes, but is not
11limited to, fire apparatus and fire department vehicles.
12    "Ambulance assistance vehicle provider" or "provider"
13means a provider of ambulance assistance vehicles that is
14licensed under this Act and serves a population within the
15State.
16    (b) An ambulance assistance vehicle provider may submit a

1proposal to the EMS Medical Director requesting approval of an
2ambulance assistance vehicle provider in-field service level
3upgrade.
4        (1) An ambulance assistance vehicle provider may be
5    upgraded, as defined by the EMS Medical Director in a
6    policy or procedure, as long as the EMS Medical Director
7    and the Department have approved the proposal, to the
8    highest level of EMT license (advanced life
9    support/paramedic, intermediate life support, or basic
10    life support) or Pre-Hospital RN certification held by any
11    person staffing that provider's ambulance assistance
12    vehicle. The ambulance assistance vehicle provider's
13    proposal for an upgrade must include all of the following:
14            (A) The manner in which the provider will secure
15        and store advanced life support equipment, supplies,
16        and medications.
17            (B) The type of quality assurance the provider will
18        perform.
19            (C) An assurance that the provider will advertise
20        only the level of care that can be provided 24 hours a
21        day.
22            (D) A statement that the provider will have that
23        vehicle inspected by the Department annually.
24        (2) If an ambulance assistance vehicle provider is
25    approved to provide an in-field service level upgrade based
26    on the licensed personnel on the vehicle, all the advanced

1    life support medical supplies, durable medical equipment,
2    and medications must be environmentally controlled,
3    secured, and locked with access by only the personnel who
4    have been authorized by the EMS Medical Director to utilize
5    those supplies.
6        (3) The EMS System shall routinely perform quality
7    assurance, in compliance with the EMS System's quality
8    assurance plan approved by the Department, on in-field
9    service level upgrades authorized under this Section to
10    ensure compliance with the EMS System plan.
11    The EMS Medical Director may define what constitutes an
12in-field service level upgrade through an EMS System policy or
13procedure. An in-field service level upgrade may include, but
14need not be limited to, an upgrade to a licensed ambulance,
15alternate response vehicle, or specialized emergency medical
16services vehicle.
17    (c) If the EMS Medical Director approves a proposal for an
18ambulance assistance vehicle provider's in-field service level
19upgrade under this Section, he or she shall submit the proposal
20to the Department along with a statement of approval signed by
21him or her. Once the Department has approved the proposal, the
22ambulance assistance vehicle provider shall be authorized to
23function at the highest level of EMT license (advanced life
24support/paramedic, intermediate life support, or basic life
25support) or Pre-Hospital RN certification held by any person
26staffing the provider's ambulance assistance vehicle.

1    (d) Nothing in this Section shall allow for the approval of
2a request to downgrade the service level licensure for an
3ambulance assistance vehicle provider.
 
4    Section 99. Effective date. This Act takes effect upon
5becoming law.".
