| 2 | | AMENDMENT NO. ______. Amend House Bill 2402, AS AMENDED, by |
| 3 | | replacing everything after the enacting clause with the |
| 4 | | following:
|
| 5 | | "Section 5. The Illinois Vehicle Code is amended by |
| 6 | | changing Section 11-1421 as follows:
|
| 7 | | (625 ILCS 5/11-1421) (from Ch. 95 1/2, par. 11-1421)
|
| 8 | | Sec. 11-1421. Conditions for operating ambulances and |
| 9 | | rescue vehicles.
|
| 10 | | (a) No person shall operate an ambulance or rescue vehicle
|
| 11 | | in a manner not conforming to the motor vehicle laws
and |
| 12 | | regulations of this State or of any political subdivision of |
| 13 | | this State
as such laws and regulations apply to motor vehicles |
| 14 | | in
general, unless in compliance with the following conditions:
|
| 15 | | 1. The person operating the ambulance shall be either |
| 16 | | responding to a
bona fide emergency call or specifically |
|

|
| 1 | | directed by a licensed physician
to disregard traffic laws |
| 2 | | in operating the ambulance during and for the
purpose of |
| 3 | | the specific trip or journey that is involved;
|
| 4 | | 2. The ambulance or rescue vehicle shall be equipped |
| 5 | | with a siren
producing
an audible signal of an intensity of |
| 6 | | 100 decibels at a distance of 50 feet
from the siren; |
| 7 | | except that, beginning July 1, 2018, in a municipality with |
| 8 | | 1,000,000 or more inhabitants, an ambulance or rescue |
| 9 | | vehicle owned by the municipality's fire department shall |
| 10 | | be equipped with a siren producing an audible signal of an |
| 11 | | intensity of at least 100 decibels, but not to exceed 101 |
| 12 | | decibels at a distance of 50 feet from the siren. The |
| 13 | | ambulance or rescue vehicle shall also be equipped , and |
| 14 | | with a lamp or lamps emitting an oscillating, rotating
or |
| 15 | | flashing red beam directed in part toward the front of the |
| 16 | | vehicle, and
these lamps shall have sufficient intensity to |
| 17 | | be visible at 500 feet in
normal sunlight, and in addition |
| 18 | | to other lighting requirements, excluding
those vehicles |
| 19 | | operated in counties with a population in excess of |
| 20 | | 2,000,000,
may also operate with a lamp or lamps emitting |
| 21 | | an oscillating, rotating, or
flashing
green light;
|
| 22 | | 3. The aforesaid siren and lamp or lamps shall be in |
| 23 | | operation at all
times when it is reasonably necessary to |
| 24 | | warn pedestrians and other drivers
of the approach thereof |
| 25 | | during such trip or journey;
|
| 26 | | 4. Whenever the ambulance or rescue vehicle is operated |

| 1 | | at a speed in
excess of 40 miles per hour, the ambulance or |
| 2 | | rescue vehicle shall be operated
in complete conformance |
| 3 | | with every other motor vehicle law and regulation
of this |
| 4 | | State and of the political subdivision in which the |
| 5 | | ambulance or
rescue vehicle is operated, relating to the |
| 6 | | operation of motor vehicles,
as such provision applies to |
| 7 | | motor vehicles in
general, except laws and regulations |
| 8 | | pertaining to compliance with official
traffic-control |
| 9 | | devices or to vehicular operation upon the right half of
|
| 10 | | the roadway; and
|
| 11 | | 5. The ambulance shall display registration plates |
| 12 | | identifying the vehicle
as an ambulance.
|
| 13 | | (b) The foregoing provisions do not relieve the driver of |
| 14 | | an ambulance
or rescue vehicle from the duty of driving with |
| 15 | | due regard for the safety
of all persons, nor do such |
| 16 | | provisions protect the driver from the consequences
resulting |
| 17 | | from the reckless disregard for the safety of others.
