AMENDMENT TO HOUSE BILL 2681




2    AMENDMENT NO. ______. Amend House Bill 2681 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Local Government Professional Services 
5Selection Act is amended  by changing Section 8 as follows:
 



6    (50 ILCS 510/8)  (from Ch. 85, par. 6408)



7    Sec. 8. Emergencies and contracts under $50,000 Waiver of 
8competition. A political subdivision may establish an  
9expedited alternative procedure waive the
requirements of 
10Sections 4, 5, and 6 if it determines, by resolution, that an

11emergency situation exists and a firm must be selected in an 
12expeditious
manner, or the cost of architectural, engineering, 
13and land surveying
services for the project is expected to
be 
14less than $50,000 $25,000. On January 1, 2023 and on January 1 
15of each fifth year thereafter, the $50,000 is increased by an 
16amount equal to the cumulation of each annual unadjusted

1percentage increase in the consumer price index-u rounded up to 
2the nearest $500.
3    An expedited alternative procedure shall establish 
4guidelines for selection based on demonstrated competence and 
5qualifications to perform the type of services required and may 
6include a request for professional services fees as part of the 
7expedited selection process. A political subdivision's 
8negotiation with a professional service firm or firms may 
9consider all of these guidelines, including a professional 
10services fee, when using the expedited alternative procedure.
11    For purposes of this Section, "consumer price index-u" 
12means the index published by the Bureau of Labor Statistics of 
13the United States Department of Labor that measures the average 
14change in prices of goods and services purchased by all urban 
15consumers, United States city average, all items, 1982-84=100.
