     Amends the Solid Waste Planning and Recycling Act. Provides that a county's revised solid waste management plan may provide for the specified collection of residential food scrap and may include a plan for access to source separated collection of residential food scrap by all county residents within 5 years. Specifies information that shall be included in revised waste management plans. Effective immediately.

1    AN ACT concerning safety.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  


 
4    Section 5. The Solid Waste Planning and Recycling Act is 
5amended  by changing Section 5 as follows:

7    Sec. 5. 
(a) Prior to adopting a waste management plan for 
8submission
to the Agency, the county shall form an advisory 
9committee, which shall
include representatives from 
10municipalities within the county, citizen
organizations, 
11industry, the private solid waste management industry

12operating within the county, local recyclers and any other 
13persons deemed
appropriate by the county.  The advisory 
14committee shall review the plan
during its preparation, make 
15suggestions, and propose any changes it believes
appropriate.

16    (b) The county shall provide written notice to all 
17municipalities and
interested members of the public when plan 
18development begins and shall
provide periodic written progress 
19reports to such entities concerning the
preparation of the 
20plan.

21    (c) Prior to adoption by the governing body of the county, 
22the county
shall submit copies of the proposed plan for review 
23and comment to the
Agency, all municipalities within the

1county, all areawide planning
agencies, and the county health 
2department.  The county shall also make the
proposed plan 
3available for public review and comment.  The period for
review 
4and comment shall be 90 days.  The county shall hold at least 
5one
public hearing on the proposed plan during this period.  The 
6plan
subsequently submitted to the governing body of the county 
7for adoption
shall be accompanied by a document containing 
8written responses to
substantive comments made during the 
9comment period.

10    (d) The governing body of the county shall adopt a plan 
11within 60 days
from the end of the public comment period.  
12Within 10 days of adoption,
the plan shall be submitted to the 
13Agency for review.

14    (e) Each county waste management plan shall be updated and 
15reviewed
every 5 years, and any necessary or appropriate 
16revisions shall be
submitted to the Agency for review and 
17comment. Beginning on the effective date of this amendatory Act 
18of the 100th General Assembly, a county's revised solid waste 
19management plan may provide for the separate collection and 
20composting of residential food scrap, and may include a plan 
21for access to source separated collection of food scrap by all 
22county residents within 5 years. Revised solid waste management 
23plans shall include information about the capacity and 
24availability of infrastructure for residential food scrap 
25composting and anaerobic digestion of food scrap within the 
26county.

2    Section 99. Effective date. This Act takes effect upon 
3becoming law.
