AMENDMENT TO HOUSE BILL 3135 




2    AMENDMENT NO. ______. Amend House Bill 3135, on page 1, 
3line 5, after "5-44020", by inserting   "and by adding Section 
45-44043"; and 


 
5on page 2, immediately below line 13, by inserting the 
6following:
 
7    "(55 ILCS 5/5-44043  new)
8    Sec. 5-44043. Rights and obligations of employees.
9    (a) The status and rights of employees represented by an 
10exclusive bargaining representative shall not be affected by 
11the dissolution of a unit of local government under this 
12Division, except that this subsection does not apply in DuPage, 
13Lake, and McHenry Counties for actions taken before the 
14effective date of this amendatory Act of the 100th General 
15Assembly.
16    (b) Obligations of the dissolving unit of local government

1assumed by the trustee-in-dissolution, county, or governing 
2body of a special service area include the obligation to honor 
3representation rights under the Illinois Public Labor 
4Relations Act and any collective bargaining agreements 
5existing on the date of dissolution of the unit of local 
6government.
7    (c) The rights of employees under any pensions, retirement 
8plans, or annuity plans existing on the date of dissolution of 
9the unit of local government are not affected by the 
10dissolution of a unit of local government under this 
11Division.".
