Amends the Counties Code. Gives non-home rule counties all of the powers provided to home rule units under Section 6 of Article VII of the Illinois Constitution, except for the powers to tax, impose fees, and to incur debt. Effective immediately.

|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Counties Code is amended by changing Section |
| 5 | | 5-1014 as follows:
|
| 6 | | (55 ILCS 5/5-1014) (from Ch. 34, par. 5-1014)
|
| 7 | | Sec. 5-1014. Powers generally. The county board of each |
| 8 | | county has
the powers enumerated in the Sections following this |
| 9 | | Section and preceding
Section 5-1105, subject to conditions |
| 10 | | therein stated. Powers conferred on
counties are in addition to |
| 11 | | and not in limitation of their existing powers.

| 12 | | It is the policy of this State that all powers granted, |
| 13 | | either expressly
or by necessary implication, by this Code, |
| 14 | | other Illinois statute, or the
Illinois Constitution to |
| 15 | | non-home rule counties may be exercised by those
counties |
| 16 | | notwithstanding effects on competition. It is the intention of |
| 17 | | the
General Assembly that the "State action exemption" to the |
| 18 | | application of
federal antitrust statutes be fully available to |
| 19 | | counties to the extent
their activities are authorized by law |
| 20 | | as stated herein.

| 21 | | Notwithstanding any provision of law to the contrary, |
| 22 | | except for the powers to tax, impose fees, and incur debt, |
| 23 | | non-home rule counties shall exercise all of the powers |
