| 3 | | replacing lines 20 through 23 with the following:

| 4 | | "(j) A home rule municipality may not assess or collect a |
| 5 | | real estate transfer tax on a deed or trust document related to |
| 6 | | the first sale of a newly constructed and unoccupied |
| 7 | | residential structure for which an impact fee has been assessed |
| 8 | | and collected by a school district, park district, |
| 9 | | municipality, or county as a condition of issuance or signing |
| 10 | | of a plat of subdivision in which the residential structure is |
| 11 | | located, the building permit for the residential structure, or |
| 12 | | an occupancy permit for the residential structure, except that |
| 13 | | the deed or trust document shall not be exempt from filing the |
| 14 | | declaration under Article 31 of the Property Tax Code.".
