AMENDMENT TO HOUSE BILL 4277 




2    AMENDMENT NO. ______. Amend House Bill 4277 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Illinois Public Aid Code is amended  by 
5adding Section 11-5.5 as follows:
 
6    (305 ILCS 5/11-5.5 new)
7    Sec. 11-5.5. Provisional eligibility determinations and 
8policies and procedures to comply with federal deadlines for 
9eligibility determinations.
10    (a) The General Assembly finds that it is in the best 
11interest of the State to process on an expedited basis 
12applications for Medicaid and Medicaid long-term care benefits 
13that are submitted by or on behalf of elderly persons in need 
14of long-term care services in order to comply with federal 
15deadlines for eligibility determinations as provided in 42 
16U.S.C. 1396a(a)(8) and 42 CFR 435.

1    (b) It is the intent of the General Assembly that the 
2provisions of this Section be liberally construed to permit the 
3maximum number of applicants to benefit, regardless of the age 
4of the application, and for the State to meet the federal 
5eligibility processing deadlines. 

 
6    Section 99. Effective date. This Act takes effect upon 
7becoming law.".
