| 5 | | adding Section 5-30.6 as follows:

| 7 | | Sec. 5-30.6. Disenrollment requirements; managed care |
| 8 | | organization. Disenrollment of a Medicaid enrollee from a |
| 9 | | managed care organization under contract with the Department |
| 10 | | shall be in accordance with the requirements of 42 CFR 438.56 |
| 11 | | in effect on January 1, 2018. Whenever a contract is terminated |
| 12 | | between a Medicaid managed care entity and a primary care |
| 13 | | provider that results in a disruption to the enrollee's |
| 14 | | provider-patient relationship, the Department shall approve |
| 15 | | any request from the enrollee for disenrollment from the plan.
