| 2 | | AMENDMENT NO. ______. Amend House Bill 4749 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Election Code is amended by changing |
| 5 | | Section 1A-16.1 as follows: |
| 6 | | (10 ILCS 5/1A-16.1) |
| 7 | | Sec. 1A-16.1. Automatic voter registration; Secretary of |
| 8 | | State. |
| 9 | | (a) The Office of the Secretary of State and the State |
| 10 | | Board of Elections, pursuant to an interagency contract and |
| 11 | | jointly-adopted rules, shall establish an automatic voter |
| 12 | | registration program that satisfies the requirements of this |
| 13 | | Section and other applicable law. |
| 14 | | (b) If an application, an application for renewal, a change |
| 15 | | of address form, or a recertification form for a driver's |
| 16 | | license, other than a temporary visitor's driver's license, or |

| 1 | | a State identification card issued by the Office of the |
| 2 | | Secretary of State meets the requirements of the federal REAL |
| 3 | | ID Act of 2005, then that application shall serve as a |
| 4 | | dual-purpose application. The dual-purpose application shall: |
| 5 | | (1) also serve as an application to register to vote in |
| 6 | | Illinois; |
| 7 | | (2) allow an applicant to change his or her registered |
| 8 | | residence address or name as it appears on the voter |
| 9 | | registration rolls; |
| 10 | | (3) provide the applicant with an opportunity to |
| 11 | | affirmatively decline to register to vote or to change his |
| 12 | | or her registered residence address or name by providing a |
| 13 | | check box on the application form without requiring the |
| 14 | | applicant to state the reason; and |
| 15 | | (4) unless the applicant declines to register to vote |
| 16 | | or change his or her registered residence address or name, |
| 17 | | require the applicant to attest, by signature under penalty |
| 18 | | of perjury as described in subsection (e) of this Section, |
| 19 | | to meeting the qualifications to register to vote in |
| 20 | | Illinois at his or her residence address as indicated on |
| 21 | | his or her driver's license or identification card |
| 22 | | dual-purpose application. |
| 23 | | (b-5) If an application, an application for renewal, a |
| 24 | | change of address form, or a recertification form for a |
| 25 | | driver's license, other than a temporary visitor's driver's |
| 26 | | license, or a State identification card issued by the Office of |

| 1 | | the Secretary of State does not meet the requirements of the |
| 2 | | federal REAL ID Act of 2005, then that application shall serve |
| 3 | | as a dual-purpose application. The dual-purpose application |
| 4 | | shall: |
| 5 | | (1) also serve as an application to register to vote in |
| 6 | | Illinois; |
| 7 | | (2) allow an applicant to change his or her registered |
| 8 | | residence address or name as it appears on the voter |
| 9 | | registration rolls; and |
| 10 | | (3) if the applicant chooses to register to vote or to |
| 11 | | change his or her registered residence address or name, |
| 12 | | then require the applicant to attest, by a separate |
| 13 | | signature under penalty of perjury, to meeting the |
| 14 | | qualifications to register to vote in Illinois at his or |
| 15 | | her residence address as indicated on his or her |
| 16 | | dual-purpose application. |
| 17 | | (b-10) The Office of the Secretary of State shall clearly |
| 18 | | and conspicuously inform each applicant in writing: (i) of the |
| 19 | | qualifications to register to vote in Illinois, (ii) of the |
| 20 | | penalties provided by law for submission of a false voter |
| 21 | | registration application, (iii) that, unless the applicant |
| 22 | | declines to register to vote or update his or her voter |
| 23 | | registration, his or her dual-purpose application shall also |
| 24 | | serve as both an application to register to vote and his or her |
| 25 | | attestation that he or she meets the eligibility requirements |
| 26 | | for voter registration, and that his or her application to |

| 1 | | register to vote or update his or her registration will be |
| 2 | | transmitted to the State Board of Elections for the purpose of |
| 3 | | registering the person to vote at the residence address to be |
| 4 | | indicated on his or her driver's license or identification |
| 5 | | card, and (iv) that declining to register to vote is |
| 6 | | confidential and will not affect any services the person may be |
| 7 | | seeking from the Office of the Secretary of State. |
| 8 | | (c) The Office of the Secretary of State shall review |
| 9 | | information provided to the Office of the Secretary of State by |
| 10 | | the State Board of Elections to inform each applicant for a |
| 11 | | driver's license or permit, other than a temporary visitor's |
| 12 | | driver's license, or a State identification card issued by the |
| 13 | | Office of the Secretary of State whether the applicant is |
| 14 | | currently registered to vote in Illinois and, if registered, at |
| 15 | | what address. |
| 16 | | (d) The Office of the Secretary of State shall not require |
| 17 | | an applicant for a driver's license or State identification |
| 18 | | card to provide duplicate identification or information in |
| 19 | | order to complete an application to register to vote or change |
| 20 | | his or her registered residence address or name. Before |
| 21 | | transmitting any personal information about an applicant to the |
| 22 | | State Board of Elections, the Office of the Secretary of State |
| 23 | | shall review its records of the identification documents the |
| 24 | | applicant provided in order to complete the application for a |
| 25 | | driver's license or State identification card, to confirm that |
| 26 | | nothing in those documents indicates that the applicant does |

| 1 | | not satisfy the qualifications to register to vote in Illinois |
| 2 | | at his or her residence address. |
| 3 | | (e) A completed, signed application for (i) a driver's |
| 4 | | license or permit, other than a temporary visitor's driver's |
| 5 | | license, or a State identification card issued by the Office of |
| 6 | | the Secretary of State, that meets the requirements of the |
| 7 | | federal REAL ID Act of 2005; or (ii) a completed application |
| 8 | | under subsection (b-5) of this Section with a separate |
| 9 | | signature attesting the applicant meets the qualifications to |
| 10 | | register to vote in Illinois at his or her residence address as |
| 11 | | indicated on his or her application shall constitute a signed |
| 12 | | application to register to vote in Illinois at the residence |
| 13 | | address indicated in the application unless the person |
| 14 | | affirmatively declined in the application to register to vote |
| 15 | | or to change his or her registered residence address or name. |
| 16 | | If the identification documents provided to complete the |
| 17 | | dual-purpose application indicate that he or she does not |
| 18 | | satisfy the qualifications to register to vote in Illinois at |
| 19 | | his or her residence address, the application shall be marked |
| 20 | | as incomplete. |
| 21 | | (f) For each completed and signed application that |
| 22 | | constitutes an application to register to vote in Illinois or |
| 23 | | provides for a change in the applicant's registered residence |
| 24 | | address or name, the Office of the Secretary of State shall |
| 25 | | electronically transmit to the State Board of Elections |
| 26 | | personal information needed to complete the person's |

| 1 | | registration to vote in Illinois at his or her residence |
| 2 | | address. The application to register to vote shall be processed |
| 3 | | in accordance with Section 1A-16.7. |
| 4 | | (g) If the federal REAL ID Act of 2005 is repealed, |
| 5 | | abrogated, superseded, or otherwise no longer in effect, then |
| 6 | | the State Board of Elections shall establish criteria for |
| 7 | | determining reliable personal information indicating |
| 8 | | citizenship status and shall adopt rules as necessary for the |
| 9 | | Secretary of State to continue processing dual-purpose |
| 10 | | applications under this Section. |
| 11 | | (h) As used in this Section, "dual-purpose application" |
| 12 | | means an application, an application for renewal, a change of |
| 13 | | address form, or a recertification form for driver's license or |
| 14 | | permit, other than a temporary visitor's driver's license, or a |
| 15 | | State identification card offered by the Secretary of State |
| 16 | | that also serves as an application to register to vote in |
| 17 | | Illinois. "Dual-purpose application" does not mean an |
| 18 | | application under subsection (c) of Section 6-109 of the |
| 19 | | Illinois Vehicle Code.

| 20 | | (i) This Section shall be implemented no later than 90 days |
| 21 | | after the federal Real ID database is certified by the |
| 22 | | Secretary of State. |
