| 2 | | AMENDMENT NO. ______. Amend House Bill 5293 as follows:

| 3 | | on page 5, by replacing lines 3 through 5 with the following: |
| 4 | | "conservation plan, or safe harbor agreement, that includes |
| 5 | | conservation practices conducted in this State in effect and |
| 6 | | approved by the United States Fish and Wildlife Service under |
| 7 | | Section 10 of the federal Endangered Species Act of 1973. |
| 8 | | Incidental taking of species which are listed as endangered or |
| 9 | | threatened by this State only and not listed by the United |
| 10 | | States Fish and Wildlife Service shall follow the provisions |
| 11 | | set forth under Section 5.5 of this Act."; and
|
| 12 | | on page 6, line 2, by replacing "2 members shall be landowners" |
| 13 | | with "1 member shall be a landowner.".
