AMENDMENT TO HOUSE BILL 5309




2    AMENDMENT NO. ______. Amend House Bill 5309 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 1. Short title. This Act may be cited as the State 
5Agency and Grantee Bonus Prohibition Act.
 
6    Section 5. Definitions. As used in this Act:
7    "Employee" means any person employed, full-time, 
8part-time, or contractually, in any capacity  by a State agency, 
9without regard to whether that person's employment is subject 
10to the advice and consent of the Senate or is for a stated 
11term. "Employee" does not include persons subject to a 
12collective bargaining agreement.
13    "Grant funds" has the meaning provided in Section 2 of the 
14Illinois Grant Funds Recovery Act.
15    "Grantee" has the meaning provided in Section 2 of the 
16Illinois Grant Funds Recovery Act.

1    "Hospital" has the meaning provided in Section 3 of the 
2Hospital Licensing Act.
3    "State agency" has the meaning provided in Section 1-15.100 
4of the Illinois Procurement Code.
 
5    Section 10. Bonuses prohibited. 
6    (a) No State agency or hospital shall pay and no employee 
7of a State agency or hospital may receive a bonus as all or 
8part of his or her compensation, including such bonuses as may 
9be received for work on capital projects.
10    (b) No grantee shall pay and no employee or contract worker 
11of a grantee may receive a bonus paid from grant funds awarded 
12for operational expenses as all or part of his or her 
13compensation, including such bonuses as may be received for 
14work on capital projects.
 
 
15    Section 99. Effective date. This Act takes effect upon 
16becoming law.".
