SYNOPSIS AS INTRODUCED:
 
325 ILCS 20/3.5 new

    Amends the Early Intervention Services System Act. Requires the Department of Human Services and the Illinois State Board of Education to jointly develop and implement a State policy under which parents of children with disabilities who previously received early intervention services under the Act may choose the continuation of those services until such children reach the age of 5 or enter, or are eligible under State law to enter, kindergarten. Provides that implementation of the new policy shall be contingent on the Department (i) holding public hearings as provided under the Act and (ii) complying with all applicable federal requirements. Effective January 1, 2019.

1    AN ACT concerning children.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Early Intervention Services System Act is
5amended by adding Section 3.5 as follows:
 
6    (325 ILCS 20/3.5 new)
7    Sec. 3.5. Continuation of early intervention services. The
8lead agency and the Illinois State Board of Education shall
9jointly develop and implement a State policy under which
10parents of children with disabilities who are eligible for
11services under Part B of the Individuals with Disabilities
12Education Act (20 United States Code 1411 through 1419 and as
13set forth in 34 CFR 300.115) and who previously received
14services under this Act, may choose the continuation of early
15intervention services (which shall include an educational
16component that promotes school readiness and incorporates
17preliteracy, language, and numeracy skills) for such children
18under this Act until such children reach the age of 5 or enter,
19or are eligible under State law to enter, kindergarten.
20Implementation of this Section shall be contingent on the lead
21agency holding public hearings on the new policy as provided in
22subsection (g) of Section 5 and complying with all federal
23requirements in 20 United States Code 1435(c).

1    Section 99. Effective date. This Act takes effect January
21, 2019.
