SYNOPSIS AS INTRODUCED:

    If and only if Senate Bill 2925 of the 100th General Assembly becomes law (in the form in which it passed both houses), amends the Illinois Police Training Act to provide that the Illinois Law Enforcement Training Standards Board may offer a school resource officer course to a qualified retired law enforcement officer. Provides that nothing in the school resource officer course provision prohibits a school resource officer or qualified retired law enforcement officer from carrying a firearm. If and only if Senate Bill 2925 of the 100th General Assembly becomes law (in the form in which it passed both houses), amends the School Code. Provides that beginning January 1, 2021, a school or school district may employ a qualified retired law enforcement officer who obtains a certificate of completion or approved waiver under the Illinois Police Training Act to carry out the duties of a school resource officer. Makes a conforming change. Effective immediately or on the date Senate Bill 2925 of the 100th General Assembly takes effect, whichever is later.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. If and only if Senate Bill 2925 of the 100th
5General Assembly becomes law in the form in which it passed
6both houses on May 25, 2018, then the Illinois Police Training
7Act is amended by changing Section 10.22 as follows:
 
8    (50 ILCS 705/10.22)
9    Sec. 10.22. School resource officer.
10    (a) The Board shall develop or approve a course for school
11resource officers as defined in Section 10-20.67 of the School
12Code.
13    (b) The school resource officer course shall be developed
14within one year after the effective date of this amendatory Act
15of the 100th General Assembly and shall be created in
16consultation with organizations demonstrating expertise and or
17experience in the areas of youth and adolescent developmental
18issues, educational administrative issues, prevention of child
19abuse and exploitation, youth mental health treatment, and
20juvenile advocacy.
21    (c) The Board shall develop a process allowing law
22enforcement agencies to request a waiver of this training
23requirement for any specific individual assigned as a school

1resource officer. Applications for these waivers may be
2submitted by a local law enforcement agency chief administrator
3for any officer whose prior training and experience may qualify
4for a waiver of the training requirement of this subsection
5(c). The Board may issue a waiver at its discretion, based
6solely on the prior training and experience of an officer.
7    (d) Upon completion, the employing agency shall be issued a
8certificate attesting to a specific officer's completion of the
9school resource officer training. Additionally, a letter of
10approval shall be issued to the employing agency for any
11officer who is approved for a training waiver under this
12subsection (d).
13    (e) The Board may offer the school resource officer course
14developed under this Section to a qualified retired law
15enforcement officer, as defined under the federal Law
16Enforcement Officers Safety Act of 2004, for the purpose of
17employment at a school or school district and may issue, for
18such purpose, a certificate or waiver in the same manner as
19provided under this Section for any other officer.
20    (f) Notwithstanding any other provision of law to the
21contrary, nothing in this Section prohibits a school resource
22officer or qualified retired law enforcement officer from
23carrying a firearm.

1General Assembly becomes law in the form in which it passed
2both houses on May 25, 2018, then the School Code is amended by
3changing Section 10-20.67 as follows:
 
4    (105 ILCS 5/10-20.67)
5    Sec. 10-20.67. School resource officer.
6    (a) In this Section, "school resource officer" means a law
7enforcement officer who has been primarily assigned to a school
8or school district under an agreement with a local law
9enforcement agency.
10    (b) Beginning January 1, 2021, any law enforcement agency
11that provides a school resource officer under this Section
12shall provide to the school district a certificate of
13completion, or approved waiver, issued by the Illinois Law
14Enforcement Training Standards Board under Section 10.22 of the
15Illinois Police Training Act indicating that the subject
16officer has completed the requisite course of instruction in
17the applicable subject areas within one year of assignment, or
18has prior experience and training which satisfies this
19requirement.
20    (c) In an effort to defray the related costs, any law
21enforcement agency that provides a school resource officer
22should apply for grant funding through the federal Community
23Oriented Policing Services grant program.
24    (d) Beginning January 1, 2021, a school or school district
25may employ a qualified retired law enforcement officer, as

1defined under the federal Law Enforcement Officers Safety Act
2of 2004, who obtains a certificate of completion or approved
3waiver under Section 10.22 of the Illinois Police Training Act
4to carry out the duties of a school resource officer.
5    (e) Notwithstanding any other provision of law to the
6contrary, nothing in this Section prohibits a school resource
7officer or qualified retired law enforcement officer from
8carrying a firearm.

10    Section 99. Effective date. This Act takes effect upon
11becoming law or on the date Senate Bill 2925 of the 100th
12General Assembly takes effect, whichever is later.
