AMENDMENT TO SENATE BILL 309 




2    AMENDMENT NO. ______. Amend Senate Bill 309 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The University of Illinois Hospital Act is 
5amended  by adding Section 8b as follows:
 
6    (110 ILCS 330/8b new)
7    Sec. 8b. Captioning required. A television in a waiting 
8room provided for use by the general public at the University 
9of Illinois Hospital, in a patient room provided for use by 
10patients being treated by the University of Illinois Hospital, 
11or in a patient room provided for use by individuals using or 
12requesting services at the University of Illinois Hospital must 
13have a closed captioning feature activated at all times if the 
14television includes a captioning feature.
15    The University of Illinois Hospital must make reasonable 
16efforts to prevent members of the general public and

1individuals using or requesting services from independently 
2deactivating a captioning feature. It is not a violation of 
3this Section if the captioning feature is deactivated by a 
4member of the general public or an individual using or 
5requesting services at the University of Illinois Hospital, so 
6long as the captioning is reactivated as soon as is practicable 
7by a member of the University of Illinois Hospital's staff upon 
8knowledge that the deactivation has occurred.
9    If the University of Illinois Hospital does not have a 
10television that includes a captioning feature, then the 
11University of Illinois Hospital must obtain a sufficient number 
12of televisions that include a captioning feature as soon as is 
13practicable. This Section does not affect any other provision 
14of law relating to disability discrimination or providing 
15reasonable accommodations or diminish the rights of a person 
16with a disability under any other law.
17    As used in this Section, "closed captioning" or 
18"captioning" means a text display of spoken words presented on 
19a television or movie screen that allows a deaf or hard of 
20hearing viewer to follow the dialogue and the action of a 
21program simultaneously.
 
22    Section 10. The Alternative Health Care Delivery Act is 
23amended  by adding Section 35.5 as follows:

1    Sec. 35.5. Captioning required. A television in a waiting 
2room provided for use by the general public at an alternative 
3health care model licensed under this Act, in a patient room 
4provided for use by patients being treated by an alternative 
5health care model licensed under this Act, or in a patient room 
6provided for use by individuals using or requesting services at 
7an alternative health care model licensed under this Act must 
8have a closed captioning feature activated at all times if the 
9television includes a captioning feature.
10    An alternative health care model licensed under this Act 
11must make reasonable efforts to prevent members of the general 
12public and individuals using or requesting services from 
13independently deactivating a captioning feature. It is not a 
14violation of this Section if the captioning feature is 
15deactivated by a member of the general public or an individual 
16using or requesting services at an alternative health care 
17model licensed under this Act, so long as the captioning is 
18reactivated as soon as is practicable by a member of the 
19alternative health care model's staff upon knowledge that the 
20deactivation has occurred.
21    If an alternative health care model licensed under this Act 
22does not have a television that includes a captioning feature, 
23then the alternative health care model must obtain a sufficient 
24number of televisions that include a captioning feature as soon 
25as is practicable. This Section does not affect any other 
26provision of law relating to disability discrimination or

1providing reasonable accommodations or diminish the rights of a 
2person with a disability under any other law.

8    Section 15. The Ambulatory Surgical Treatment Center Act is 
9amended  by adding Section 7c as follows:

11    Sec. 7c. Captioning required. A television in a waiting 
12room provided for use by the general public at an ambulatory 
13surgical treatment center licensed under this Act, in a patient 
14room provided for use by patients being treated by an 
15ambulatory surgical treatment center licensed under this Act, 
16or in a patient room provided for use by individuals using or 
17requesting services at an ambulatory surgical treatment center 
18licensed under this Act must have a closed captioning feature 
19activated at all times if the television includes a captioning 
20feature.
21    An ambulatory surgical treatment center licensed under 
22this Act must make reasonable efforts to prevent members of the 
23general public and individuals using or requesting services 
24from independently deactivating a captioning feature. It is not

1a violation of this Section if the captioning feature is 
2deactivated by a member of the general public or an individual 
3using or requesting services at an ambulatory surgical 
4treatment center licensed under this Act, so long as the 
5captioning is reactivated as soon as is practicable by a member 
6of the ambulatory surgical treatment center's staff upon 
7knowledge that the deactivation has occurred.
8    If an ambulatory surgical treatment center licensed under 
9this Act does not have a television that includes a captioning 
10feature, then the ambulatory surgical treatment center must 
11obtain a sufficient number of televisions that include a 
12captioning feature as soon as is practicable. This Section does 
13not affect any other provision of law relating to disability 
14discrimination or providing reasonable accommodations or 
15diminish the rights of a person with a disability under any 
16other law.
17    As used in this Section, "closed captioning" or

22    Section 20. The Community Living Facilities Licensing Act 
23is amended  by adding Section 5.5 as follows:

3Living Facility licensed under this Act, in a resident room

5Living Facility licensed under this Act, or in a resident room 
6provided for use by individuals using or requesting services at 
7a Community Living Facility licensed under this Act must have a 
8closed captioning feature activated at all times if the 
9television includes a captioning feature.
10    A Community Living Facility licensed under this Act must 
11make reasonable efforts to prevent members of the general 
12public and individuals using or requesting services from 
13independently deactivating a captioning feature. It is not a 
14violation of this Section if the captioning feature is 
15deactivated by a member of the general public or an individual 
16using or requesting services at a Community Living Facility 
17licensed under this Act, so long as the captioning is 
18reactivated as soon as is practicable by a member of the 
19Community Living Facility's staff upon knowledge that the

21    If a Community Living Facility licensed under this Act does 
22not have a television that includes a captioning feature, then

24of televisions that include a captioning feature as soon as is 
25practicable. This Section does not affect any other provision

8    Section 25. The Nursing Home Care Act is amended  by adding 
9Section 3-801.2 as follows:
 
10    (210 ILCS 45/3-801.2 new)
11    Sec. 3-801.2. Captioning required. A television in a 
12waiting room provided for use by the general public at a 
13facility licensed under this Act,  a resident room provided for 
14use by residents being treated by a facility licensed under 
15this Act, or in a resident room provided for use by individuals 
16using or requesting services at a facility licensed under this 
17Act must have a closed captioning feature activated at all 
18times if the television includes a captioning feature.
19    A facility licensed under this Act must make reasonable 
20efforts to prevent members of the general public and 
21individuals using or requesting services from independently 
22deactivating a captioning feature. It is not a violation of 
23this Section if the captioning feature is deactivated by a 
24member of the general public or an individual using or

11accommodations or diminish the rights of a person with a 
12disability under any other law.

18    Section 30. The MC/DD Act is amended  by adding Section 
193-801.2 as follows:

21    Sec. 3-801.2. Captioning required. A television in a 
22waiting room provided for use by the general public at a 
23facility licensed under this Act,  a resident room provided for 
24use by residents being treated by a facility licensed under

2using or requesting services at a facility licensed under this 
3Act must have a closed captioning feature activated at all 
4times if the television includes a captioning feature.

8deactivating a captioning feature. It is not a violation of

3adding Section 3-801.2 as follows:

5    Sec. 3-801.2. Captioning required. A television in a 
6waiting room provided for use by the general public at a 
7facility licensed under this Act, in a resident room provided 
8for use by residents being treated by a facility licensed under 
9this Act, or in a resident room provided for use by individuals 
10using or requesting services at a facility licensed under this 
11Act must have a closed captioning feature activated at all 
12times if the television includes a captioning feature.
13    A facility licensed under this Act must make reasonable 
14efforts to prevent members of the general public and 
15individuals using or requesting services from independently 
16deactivating a captioning feature. It is not a violation of 
17this Section if the captioning feature is deactivated by a

12    Section 40. The Specialized Mental Health Rehabilitation 
13Act of 2013 is amended  by adding Section 2-101.5 as follows:

15    Sec. 2-101.5. Captioning required. A television in a 
16waiting room provided for use by the general public at a 
17facility licensed under this Act, in a consumer room provided 
18for use by consumers being treated by a facility licensed under 
19this Act, or in a consumer room provided for use by individuals 
20using or requesting services at a facility licensed under this 
21Act must have a closed captioning feature activated at all 
22times if the television includes a captioning feature.
23    A facility licensed under this Act must make reasonable 
24efforts to prevent members of the general public and

2deactivating a captioning feature. It is not a violation of

3licensed under this Act, in a patient room provided for use by

6requesting services at a hospital licensed under this Act must 
7have a closed captioning feature activated at all times if the 
8television includes a captioning feature.
9    A hospital licensed under this Act must make reasonable 
10efforts to prevent members of the general public and 
11individuals using or requesting services from independently 
12deactivating a captioning feature. It is not a violation of 
13this Section if the captioning feature is deactivated by a 
14member of the general public or an individual using or 
15requesting services at a hospital licensed under this Act, so 
16long as the captioning is reactivated as soon as is practicable 
17by a member of the hospital's staff upon knowledge that the 
18deactivation has occurred.
19    If a hospital licensed under this Act does not have a 
20television that includes a captioning feature, then the 
21hospital must obtain a sufficient number of televisions that 
22include a captioning feature as soon as is practicable. This 
23Section does not affect any other provision of law relating to 
24disability discrimination or providing reasonable 
25accommodations or diminish the rights of a person with a 
26disability under any other law.

12community-integrated living arrangement certified under this 
13Act, in a resident room provided for use by residents being 
14treated by a community-integrated living arrangement certified 
15under this Act, or in a resident room provided for use by 
16individuals using or requesting services at a 
17community-integrated living arrangement certified under this 
18Act must have a closed captioning feature activated at all 
19times if the television includes a captioning feature.
20    A community-integrated living arrangement certified under 
21this Act must make reasonable efforts to prevent members of the 
22general public and individuals using or requesting services 
23from independently deactivating a captioning feature. It is not 
24a violation of this Section if the captioning feature is

8under this Act does not have a television that includes a 
9captioning feature, then the community-integrated living

13disability discrimination or providing reasonable 
14accommodations or diminish the rights of a person with a 
15disability under any other law.
